In 2000 i filed bankruptcy. I receive a credit card from First Consumers Natl Credit. They said that this is a way to establish credit.
The credit limit on the card was $300 a month. The payment on the card was $10.00 a month i would send them $25.00 to 30.00 a month and the fee would constantly go up.was.
I called First Consumers up and ask them why my balance is continue to go up when i double my payment every month. They said my payment is due on the 1st of the month. I said well i have been sending my payment out a head of time and if you all received it later that is know fault of mine. My payment should not been going up every month if i double up every month. I ask them to check the postal stamp and the check date when they receive my payment.
I notice every statement my payment and my balance was higher. I called and asked them to cancel the credit card now First Consumer has sent my account to a Credit Collector and i receive a court date in the mall for this year from the creditor trying to place a garnishment on my wages.
This credit company that they sold or gave the account to is telling me i owe over $800 on the card i told them that the card has been cancel and i don't owe that.
These people has constantly called my job when i ask them not to and calls my house when every they feel like it. Asking me time and time again where i work and my social. I told them time and time again that my social and my work information they have already. I should not have to pay finance charges for something i know i didn't create.
I told the Lawyer that i had gotten a $300 credit limit and i was sending in payment as i agree and i also cancel the credit card, because i didn't understand why the balance kept going up.
On Monday i spoke with a representative of Wolpoff & Abrason, LLP who now has the account. I was offer a seattlement for half on the $825.00 now today i called and i said i didn't want a garnishment and that i am going to borrow the money to pay the seattlement off, now they are telling me that there was know way possible that someone from there office agree on such terms.
I gave them the person name and information that i talked with.
I never ask them to send this credit card to me and i have paid off the card with the monthly payment i was making.Wolpoff & Abrason said i never paid anything and that is not there problem i have to pay them all the money or show up in court on August 4, 2003.
This is ridiculous i never ask First Consumers to send me a credit card. I have a car payment and i have never miss a payment on this car so i could establish my credit, so why would i not pay off $300.00 credit limit.
I have gotten incontact with a credit consumer counseling service to pay these people off so that i won't have a garnishment on me.
I really fill i was treated unfarely and i should not be pulled in court or make arrange to pay for something i had already paid.
