First Data sold me noncanceable four year lease for approximately $60 per month for a machine that retails at approximately $700. The cost of the machine was never told to me or given an option to purchase this machine. This contract was entered into November 2005. The machine - a wireless 8000 Nurit was not used until April 2006. My bank account was not charged for the monthly lease on this machine until May 2006. If this lease had been charged on a timely manner, I would have cancelled the lease immediately and sent the machine back. They have stated that they would have had to cancel the lease if the machine had never been used. But they deliberately did not charge by account until the machine had been used.


If I fulfill this contract, I will have paid out over $2800 for a machine that costs $700. When I called the leasing company after three months of payment, they stated that it would cost me @2961.73 if I purchase the equipment, and $2676.46 if I send the equipment back. Therefore, it is assumed that the FMV of this equipment if approximately $300. Simple interest calculation, they are receiving 75-80% interest rate. This is outrageous and I need help on what my options are.

When you agree to a lease with First Data they only piece of paper that states the lease is the main page and there is no signature required by anyone at all.
It shows the term or months and the monthly price. To view the lease conditions you have to read through the 32 page program guide. Who has time to do this before signing? The confirmation page you sign states you have received and read the booklet even though you have not. BUT, they have you now and you will NOT get out of the lease. You are stuck with a high monthly lease payment for a piece of equipment that you can purchase for under $300.00 at office supply stores.
First Data, a company that is like a vacum cleaner, they will suck every penny they can from every business owner.

If your credit report can withstand the "hit", WALK AWAY!

Paying the company DOES only allow the company to continue their unethical tactics. Maybe the contracts are legitimate and fully compliant with all U.S. law, but so what? What they offer is in no way ethical. They rely on taking advantage of people with their outrageous leases. THEY KNOW THIS. Why be any better than they are?

Generally speaking, I don't know why anyone leases anything, to begin with. In researching the whole leasing versus buying, I have yet to see where it is an advantage, in the end, if at all, to have leased versus buy.

Carol, as a businesswoman, you should know that you don't even buy bubblegum without checking around to see where the best deal is. Why spend a quarter in the vending machine, if you can buy a whole bag for under a buck?

You also know that you can't trust a credit terminal salesman.

But, this kinda thing happens. People are busy. No time to check around. The next thing you know, you're agreeing to spend big bucks.

So, now you're stuck in this sucker deal. There's only one way out. Refuse to pay.

You can't argue the contract. It'll hold up.

Now, it's time to do the research and find the best value. What's it gonna cost you to change over? What will you save if you dump this nurit nonsense?

You already know that the company will be mad if you close the account and they can't get any more money from you. I'm sure they'll be some yelling. Probably, some hurt feelings and a whole bunch of disappointment too.

You have to ask yourself, which is easier? To keep on paying or to make the nurits mad?

Personally, if I woke up and found myself in this deal, I'd take out an ad and sell the machine in the newspaper. That gets my money back. Then, I'd close the account. That solves the payment problem.

After that, it's just a matter of dealing with the angry phone calls. For me, that's not a problem. What about you?

The bottom line is that there's no easy way out once you step in crap. Even after you scrape the mess off your shoes, the smell still lingers on.

You'll be fighting with this credit terminal nonsense for years to come, I suppose. The only question you have to ask is which is easier, paying the money, or dealing with the stink of a deal gone bad?

Make no mistake. Once you stop paying, they will eventually go away. Sure, they'll be mad. Collection-agency mad. Unpaid debt on your credit file mad. But, in the end, everyone ends up going away empty-handed.

Research Before Signing

I would suggest that you research the FMV of the equipment before you sign the NON-CANCELABLE lease agreement. The lease paperwork would have stated that you were paying $60.00/month for 48 months. If you did the math, you would have seen that it came out to well over $2,000.00. At that point, you should have disputed this with the Sales Rep, and seen what other alternatives were available.
