I have had my home loan with First Franklin Loan Services for over five
years. I was always on time with my payments so I was given a fixed
rate. However after August of 2009 I lost my child support and on
February 08,2010 I was laid off of my job.
I began back in August of 2009 sending in documentation stating I needed
a modification to which I was told repeatedly I did not qualify till my
whole credit report reflected my life was in disaster financial status.
The Supervisor I spoke to told me he had a person who had asked for a
modification that had not paid their house payments for six months but
due to their credit report reflecting they where paying all their other
bills on time he was foreclosing on their home. He then said if I did
not like it I might want to contact my Congressmen. He was very rude, condescending toward me.
On February 08, 2010 when I was laid off of my job I called them
immediately. I was assured by First Franklin representatives three
times that I qualified for a Forbearance an then another review for a
Modification.
My file was assigned to a Mr. Joseph Lacey ext. 72134. He requested I
send in 3-months of bank statements which I did along with all documents
pertaining to my bills, finances, and confirmation of being laid off
along with my unemployment paperwork. They verified they got it and
scanned it into my account for Mr. Lacey. When I called to speak to Mr.
Lacey on March 26th 2010, he denied he got the requested paperwork. With
a great deal of insistence I got him to look in his system to which he
found the paperwork. He acted like he had no idea I was requesting a forbearance which struck me as odd since he was the one who asked for my bank statements.
He said let me talk to my Supervisor. He thought he had put me on hold
but I overheard the entire conversation. Mr. Lacey acted like he had not
prior idea I had asked for a Forbearance. His Supervisor, some female after she took a brief look at my file,
said tell her NO, that she needs to pay the full amount or we will
foreclose in 4-months. He got back on the line and said he could not
approve my request for I made too little money on Unemployment. He said I
highly recommend that you pay the full amount due. He said he would
look at it again to see if I qualified for the New Fannie Mae guidelines
that where coming out in about a week for he had 10-loans on his desk
for the same request.
I called yesterday, March 30th, 2010 and asked the person I spoke to if
Mr. Lacey had approved my forbearance yet. The rep read off the notes
again to me and said my forbearance was still being reviewed, it was not
approved and it was recommended by Mr. Lacy that I pay the full amount.
I asked him about the statements I have found on this site from others
if these specific statements where true about their business practices
to which he said that First Franklin always conducts their modifications
legally? I said why did you tell me I qualified for a forbearance then a
modification and now your telling me the opposite? How does one pay
when they are laid off? The rep just said pay or we foreclose period.
I have contacted an attorney for I have been lied to by First Franklin
Loan Services, and want to know if any attorney is willing to help us
with a Class Action Law Suit?
I am trying to register with NACA in the meantime for help.
The business practices of First Franklin Loan Services reflect
dishonest double talk,and lies. I am concerned they are taking advantage of their
customers only to regain the properties, take money from the government
illegally and get as much money from people who have been thrust into a
serious financial situation against their will without any mercy or
help. They tell me lies by script then turn around and talk to me like I
am nuts to think they have any intention of complying with the New
Federal Mortgage Regulations.
I wonder from the treatment I have had with their company, if it is
possible they are illegally taking these Federal Modification funds,
refusing modifications and getting away with it legally?
From what I can see they have exhibited dishonest and misleading
promises to us the customers, they never send any paperwork to document
their intentions to help us and should be reported to the Federal
Government for such illegal investigation based upon their actions. This
is based on my own experience and other postings I have found on this
site. I have sent my situation to Fox News for help also.
Is there anyone out there that has any answers?

First Franklin bails

After over two years of pleading First Franklin as they have done to hundreds of their customers refused my pleas for help for the fourth time and then SOLD my loan to a company based out of Texas called RCS whom have just become approved to purchase Fannie Mae Loans to Foreclose on them. They are part of Fannie Mae's Foreclosure programs I can only suppose. They are offering help but I have little faith in them after dealing with First Franklin.

I decided if I can not afford an attorney I am going to find a way to get to the truth about the dishonest business practices of First Franklin Loan Services.
I have filed complaints against them with emails to the President Obama, The President's Economic Recovery Advisory Board, Fannie Mae's mortgage fraud division, and Fox News.
I will keep it up till someone listens to my concerns and fears that this company is getting away with possible mortgage fraud in their own twisted legal fashion.
Everyone who has posted their experiences on this site needs to file complaints too. for they need to know what First Franklin is doing to their policy holders!
First Franklin needs to be investigated for possible mortgage fraud and everyone of us needs to make some noise about this to higher officials or they will continue to get away with this dishonest conduct harming even more families lives.
They just told me this week that Mr. Lacey of First Franklin expects me to pay my full mortgage payment while I am on unemployment? He has denied my pleas for a Forbearance. Most likely he has lied to me about submitting my paperwork for a modification just to set me up to loose my home but I will fight back.
Here are sites you can file your concerns to, along with contacting your local State Attorney Generals offices to see if they can investigate First Franklin for possible dishonest business practices and mortgage fraud. If enough of us post our experiences they have to take notice and do something.
