I recently found out that I was "scammed" thru Economic Freedom Corporation 6/22/2011 for over $30,000 which was invested back in September 2010.
First National Bank Omaha refuses to help me out they claim that they have a 120 day cut off....
Well if you just found out that it was a total scam and you notify your creditors of it immediately they should all honor the 'ZERO FRAUD TOLERANCE POLICY"..........and go after the companies who are still conducting business under different names......
I always had a great credit relationship with them and the only charge on that card was for this "SCAM"...
Shame on them, they are also fleecing the public with their ridiculous policy's.....It isn't as if they could write it off............WE are the ones keeping the banks in business!!!!!!!!

not by your bank. As someone already indicated, you generally have 60 days at even the best banks to identify fraud; the fact this bank gives you 120 days is unreal and very generous. Within that period, if you identify your transactions as fraudulent within that time, you have the ability to stop the transactions and possibly get them reversed (subject to some deductible amount). If you don't act within that time, you are accepting those transactions as legitimate. That's why it's important to do your due diligence on investments prior to sinking money into them, and not after the money has already been transacted.
In this case, you have not identified whether the corporation is a sham or not; I can only assume it is since your intent is to have the bank write off the money you've invested. However, it is not the bank that is responsible for making you whole. A bank is not some entity that can make you whole if you invest money in a scam, in the same way a brokerage is not responsible for your losses if you buy a poor performing stock.
I would file a police report; you have suffered a theft, and there needs to be someone to investigate this. You will likely be able to itemize the loss on your tax return, in which case - the government will reimburse you for a portion of your loss, and the police report will serve as your documentation for the loss, amongst other documents. This bank actually seems more generous in their policies. Most that I've dealt with have a 60 day cutoff to report a fraudulent transaction.
At some point, you have to take responsibility for the financial decisions you make. Expecting an unlimited time period to dispute a transaction is unrealistic.

In response to your inquiry, no this was not the first time I used them I had an account with them for years and always paid them off!!!
That card had a ZERO balance on it when I used it for this investment.
I'm sorry for upsetting you and I "FILED" a police report, reports with the BBB of Arizona. the Attorneys General office of Arizona, and also with US Dept of Justice in Washington....and they were the ones who claim that it is Consumer/Fraud, and it should be a ZERO FRAUD TOLERANCE POLICY. They have all of the paper work and working on this.
I only pray that you do not become a victim.
You don't here about complaints when Doctors, Lawyers and extremely affluent people are scammed and according the the Justice Dept it happens to them everyday also....
If I had know that I and hundreds of others were being scammed within the 120 days don't you think I would have put a stop to it then?
These people are very good at what they do, they are still working under different names
i.e. My Choice Business Services and many other titles, according to Arizona channel 3 on your side.

I'm not saying you were or you were not ripped off, but your report is lacking quite a bit of detail as to what may be the entire story.

- According to them their policy is for 120 days. The happened in around 9 months ago. Just how long should they maintain this "policy" for you? 4 months, 6 months, exactly the same amount of time before you report it?

- What are you trying to say? Did you mean that they could not write it off(that is take the loss). Well you do know that companies never "take the loss". They always pass those losses onto consumers. So yea if you got your 30K back, somewhere down the line other customers would have felt that loss. Either in the way of higher interest rates, fees, or loss of services.
If you mean that they could write it off, then yes they don't really "loose" any money. But the write off you are talking about is in taxes. So that is a loss there and then EVERYONE who pays taxes will actually absorb the loss.
WE are the ones keeping the banks in business!!!!!!!!
