I signed a lease agreement in April 2011 with Four Winds Realty to rent a home from them. I paid the first month's rent and a $500 deposit. I told them I would move in May 1st.

At this time Phil Daniels told me that the home was not available because he had to make some changes because of a complaint filed against him for inappropriately renting his home to the previous tenant for the upstairs portion of the home and then also renting the downstairs portion to another family. Bountiful city would not allow him to rent the home to two separate families. Mr. Daniels told me that it would be ready the following month.

On May 1st I again paid the rent expecting that I would be able to move in May 1st. The middle of May I contacted Mr. Daniels about a move in date and he said that the house still wasn't ready, but that it would be by June 1st.  I called Mr. Daniels again at the beginning of June and he said that he still had to put carpet in and that it would be ready within the week.

Toward the end of June I called Mr. Daniels and let him know that I wouldn't be paying any more rent to him and since I had not been able to use the home for the two months that I had paid rent for that I wanted a refund of my deposit. I said that based on the term of the lease that he could keep the two month's rent for the penalty of bowing out on the lease within the first year. He said that he would have his mother contact me.

A few weeks later Marjean Daniels emailed me and asked for information about the lease agreement I had with her son. She said that she would get back to me about returning my deposit money. I have not heard heard  back from her. I have emailed her and her son 3 times and they refuse to respond.

Four Winds Realty appears to be habitually ripping off renters or potential renters. I will also be filing a complaint with Bountiful city since Mr. Daniels is again renting this home to two separate families and calling them "room mates" to try to get around Bountiful cities ordinance for not renting single family dwellings to multiple families.

If I understand your report, you paid a security deposit and 2 months rent and yet they wouldn't let you move in.  They owe you a full refund of the monies you paid, not just the security deposit.

I would send them a certified, return receipt requested letter demanding a full refund of the monies you have paid and that you expect full remittance within 15 calendar day or you will file a civil complaint with the local small claims court and a criminal fraud complaint with your State Attorney General.

After 15 days, sue them!  Do not lose your copy of the lease agreement or payment receipts-you'll need to show those to the court.  Don't forget to file a fraud complaint!
