Galaxy Mall ripoff results in more than full cash refund Orem Utah

In August 2000, a friend and I both attended Galaxy Mall's presentation seminar and signed up. When we realized they had fooled us into thinking we were receiving web-presence in return for our $3,200 each, I went to an attorney.

In the small print on the back of the sales slip, the attorney pointed out that to hinder consumers from suing the company, they required consumers to come to Utah to sue them.

I made phone calls and found the Small Claims Court in Orem, Utah. I was directed to their website and read all the rules. I filed my complaint and paid a process server (also found by talking to a woman over the phone at the Orem court).

My friend and I were given separate court dates two weeks apart. We flew into Salt Lake City, rented a car and drove to Orem about 45 minutes away both times.

We won both of our cases, Galaxy appealed. The judge was annoyed that Galaxy appealed the decision with no basis other than to harass my friend and I by making us fly up again, rent the car, etc. So up to the end they employed dirty tactics.

Fortunately for my friend and I, we both could afford the extra expense and both of us could get off work.

In the end, each of us received a full refund plus all expenses to sue (airfare for both of us to fly up 4X-- since we went together as a witness for the other at each hearing, food, van service to the airport in California, rental car in Utah, court filing fees, process service fee).

In court at my appeals hearing, their team of attorneys told the judge that this was the first time they had a dissatisfied customer. I produced the Better Business Bureau report off the Internet that showed another customer had sued them! Ha-ha!

Looking back, the whole experience was kind of fun and sure makes a great story. It took about 6 months from writing a demand letter (sent registered mail) for a full refund to a settlement check. I went from feeling like a fool to feeling fantastic.
