 Gene requested that I prepay for a Rolex watch I was ordering for my wife. On Deceber 3 he texted me: "Hi. Any way you could wire me the balance? Watch will be here in a day or two. Need to pay the dealer " I responded "Sending $13,000 now" December 9 Gene, could you provide me with an update on when you plan to ship the watch? "Hi. Was going to contact you. AD is asking for full name to put on the warranty card and address, please. They're slow now because of the upcoming holidays but at least I'm getting it from a US dealer....which is better and faster" December 29 "Hi. The watch should be here in the first few days of January. Thank you " January 18 Gene, Could you provide me with an estimated shipping date? Who will be shipping and by what means will it be sent? Thank you January 25 "Steven, i heard your message. This week we'll resolve this one way or the other. " January 29 "Good morning. I'm going to be between queens and Brooklyn all day. Could i make an appointment with you for Monday? You're in Manhattan, right? " February 1 Gene, Are you going to meet me in Madison NJ as you agreed? "Steven, please send me your wiring instructions. We won't need to meet. Thank you. Please text them " February 2 Gene, I did not hear from you and you did not wire my deposit back to me as I have requested several times and as you have promised to do several times without success. I will no longer acquiesce to your postponements. I am turning this over to my attorney. February 4 "I will refund you asap, a matter of days. I'm not a thief. Just a little bit more patience. Thank you, Sir" February 4 Dealer contacted me. He has had the watch ready for shipment since December 28, 2015. You have never paid him. You didn't need my funds to place the order. You lied, you stole my money to cover another of your multitude of lies. That is theft and fraud. You are a liar, and a thief. "Give me one-two days, please, and I'll refund you. You can call me whatever names and i deserve it but i think it's still better for both of us if I simply refund you." February 12 "Steven, need your account number at chase, please. I can't find your information. Making 2 or 3 deposits today through Tuesday. 4500 ready now from a chase account, so will be available immediately. Thank you" February 19 When do you expect you will pay the remaining $8,500 that you owe to me? February 20 I have not heard any more from you on your plans to repay me the balance due. When are you going to address this? February 21 "Hi. I'm still in NY, going back to Chicago tomorrow. I'll write over the weekend on a specific plan for the balance. Please rest assured it will be paid" I had to separately pay the dealer $13,390 for the watch. Still waiting on the remaining $8,500 from Gene. You can see from the texts above how he works.
