Gringo's Tacos Chris Formica (owner) gringo is full of himself and full of beans he said he decides if and how much of my deposit i get back west covina, California

Feb 8, 2012 my mother and I met with owner Chris Formica owner of Gringo's Taco's to discuss having him cater my wedding scheduled for April 21, 2012.  My mother mentioned that he had failed to mention his cancellation policy and he stated to both my mother and I that he didn't really have one but as long as an event was cancelled prior to 2 weeks before the scheduled event he would be able to refund 100% of the monies paid. 

He went on to say that it was only after two weeks before the wedding that he would not be able to refund and money.  The total amount due was 912.00 and Mr. Formica asked for 1/3 of the total bill which would be 304.00.  I wanted to pay the balance in full but my mother suggested we used the cash for other things during the week.  We agreed we would pay 456.00 1/2 of the total bill with the understanding that in the event of a cancellation all payments were 100% refundable prior to 2 weeks before the scheduled event.

Less than 3 weeks later we had to cancel our wedding.  I called Chris many times leaving messages to return my phone calls.  When I was finally able to reach hiim by text he stated he will only refund 200.00.  I would gladly agree to this if it was 200.00 of the 1/3 down which would be 304.00 - 200.00.  He stated it was 200 of the whole deposit of 456.00. I told him this was unexceptable and I expected my total deposit of 456.00 to be mailed to me within 10 days of this conversation. .I cancelled the party the week of Feb. 20, 2012. 

Today is May 16, and I still have not received my refund, a phone call from Mr. Formica, or any good reason why he would think he is entitled to keep my money.  My mother and her friend have been to his store on Pacific Ave. many times to try to reach some agreement but he has his employees cover for him while he hides in the back room.  The last time I talked to Chris he agreed to talk to his accountant and get back with me by March 8, 2012.  This was just one of his many many broked promises.
