In December 2006, my expecting wife and I were introduced to custom home builder Robert (Bob) Macdonald, owner of Hartland Contruction of Milford New Hampshire. We paid Bob $5,000 to design us a home, and gave him another $1,000 to reserve a piece of land that we were thinking of building on. Per the agreement, the $1,000 deposit would be completely refundable if we did not buy the land for any reason. We signed a Contractor Agreement with Bob on December 21st, 2006 detailing all of this.

In January, due to economic reasons, we were unable to safely move forward, and immediately informed Robert MacDonald of Hartland Construction that we would be putting plans on hold for a few months, and respectfully requested the return of our $1,000 deposit. We did not request a return of the $5,000 for designing the house.

It is now June 4th 2007, and our attorney has repeatedly requested Mr. MacDonald return our $1,000 deposit, but to no avail. I sent him another letter three weeks ago advising Robert MacDonald of Hartland Construction in Mildford New Hampshire that I would take appropriate action if the deposit was not returned by the end of the month.

Please be warned not to do business with Hartland Construction and Robert (Bob) MacDonald. He is a smooth talker, and will rip you off without hesitation. Thankfully I found out his true colors before I gave him more of my money.

The Agreement Is Crystal Clear and Tells the Whole Story

This is an update regarding my complaint that Robert MacDonald of Hartland Construction failed to return my fully refundable $1,000 deposit, and somehow feels he is entitled to this money, I fully encourage anyone to fax me at 617-321-4024 with a return fax number, and I will gladly fax the signed agreement to you. It states that the $1,000 is fully refundable if I do not buy the land for any reason.

Based on Bob's rebuttal, he has no intentions of returning my $1,000 deposit, even though he was paid $5,000 for house drawings as per the agreement. This will be my final entry here, and I will now pursue small claims court for resolution.

Hartland Construction is an honest company.

Mr. MacDonald (Hartland Construction) did work for my house last fall. He was very clear about pricing and provided me with superior design plans that went beyond what I expected. I heard about Hartland Construction because of coverage in Architect Digest, I was looking for that level of expertise and professionalism.

I would highly recommend Hartland Construction to any home owner. Please feel free to contact me for further comments.

What he said is not true. I designed the entire house for him as per contract for $5,000.00. Got his approval to proceed, at which time he could have received his deposit check on the land for $1,000.00 back before I proceeded with the project. At that time he gave me the go ahead to proceed. At my expense I lined up financing for the project and had several meetings with these people. Gave them pricing on upgrades that they requested. Was waiting for them to put down the rest of the deposit on the project of $40,000.00 and kept getting the run around that he was waiting for some big deal to come through and could I get an extension to hold the land.

After putting a lot of time into the project he decided to back out. He was the smooth operator not me. I was only doing what he told me to do. It was him that told me to proceed. He also was giving me the run around about the fact that he had been approved for the loan of $800,000.00. We never received such a letter from his bank. He had his chance to back out, but told me to move ahead which I did. I don't work for free. The $1,000.00 does not even cover my time and expenses.
