Home Eq. Servicing-Wachovia Securities Endangers Life Of Severely Disabled, Manipulates Sheriff And Justice System Raleigh North Carolina

I am the primary caregiver to my mother who suffers from kidney disease and a rare disorder (Wegener's Granulomatosis) which destroys both kidney function and the ability to breathe through creating a dangerous mist (similar to pneumonia) which smothers the lungs, along with greatly weakening the immune system, and its ability to fight common illnesses. Due to this tragedy our family filed for bankruptcy to save our home. During this time, Homeq-Wachovia Securities deliberately embellished attorney fees and other so-called "fees" and in so doing, demanded over a $52,000 "arrearage" in order for us to save our home. At that time (February 2007) my mother had just returned home from the hospital where she had spent four out of the last six weeks undergoing two major surgeries, where she nearly died of a blood clot and severe hemorrhage due to a badly misplaced fistula. When returning from the hospital, my mother began to undergo up to sixteen hours of home dialysis per day which CANNOT be performed in a hospital (because it is Peritoneal dialysis for which there are no in-house experts or trainees. A special nurse has to be called out of the hospital simply to perform one of these treatments, which in that waiting period, can result in sudden death.)

Wachovia Securities-Homeq. knew of my mother's disablity, home life-support and dialysis treatment and life-threatening illness since at least the late winter of 2007. (It is also vital to note that all medical or dialysis supplies must be stored in a cool environment, that is less than 77 degrees Farenheit, in order for the liquid solution to work. This fact plays a vital role in any sudden eviction which greatly imperils my mothers life as you shall see.)

Because of extensive water damage to our home, we were able to negotiate an offer (with assistance from a relative) to repurchase the home after pictures were made documenting the damage. An offer was made beginning early in April before any eviction notice was issued. The offer was never denied by Wachovia/Homeq. Yet Wachovia-Homeq. issued an eviction notice giving a deathly ill and severely disabled person less than one week to move thousands of pounds of life-sustaining dialysis supplies (which are sent in bulk only once per month), not to mention over a half-century of both her, my father's and my possessions out of our home (with no new home to move to), giving us absolutely no warning in the process. When we finally heard from their Vice-President Jeff Szymendera, they finally disclosed the specific offer that they desired, we made the offer, and they accepted the offer. Yet they refused to name a closing date, for they refused to return any of our calls or e-mails, including those of the broker they hired (Brian Stiles at Century-21 Premier), which resulted in yet another surprise eviction notice at the end of May, giving us five days or less to vacate the premesis.

Wachovia Securities-Homeq. has deliberately excaberated the situation by not returning e-mails and phone calls, resulting in sudden eviction notice after eviction notice which recently had to be fought in court in order to save my mother's life. In this hearing which occurred on July 26, 2007, the judge ordered that the matter be resolved by August 23, 2007. My uncle, who made the original offer on our home, is in and out of the country on business, and being that he is an investor who works overseas, he is out of town for weeks and sometimes months at a time, and has not been available to sign the papers, (yet it was understood by both sides, AND in court on July 26, 2007, that our investor may be out of town on and or BEYOND that of August 23, 2007.)

Therefore in anticipation of this fact (that our investor would be out of town at or beyond August 23, 2007 as was documented to Wachovia-Homeq. previously), in early August 2007, we secured a loan on the property (in order to counterweight any nefarious attempt of another sudden and malicious eviction), which though the loan takes at least several weeks to process, has been ostensibly approved. Through this loan, though we are not responsible for the damage to the home (the formerly named Phillip's builders are and/or Wachovia-Homeq.), we nevertheless volunteered to repair the damage ourselves (that is, me and my father) at no cost to Wachovia-Homeq., and in exchange Wachovia-Homeq. receives the full beneifts of our loan (as if the home was in perfect condition) yet still Wachovia-Homeq. will neither confirm nor deny this offer because we defeated them in court on July 26, 2007, when they deliberatalely and maliciously placed my mother's life in peril. (In the ruling in Sumner County General Sessions Court, both we the occupants and Wachovia-Homeq. were ordered to close the deal by August 23, 2007, one way or the other. Yet the reading was interpreted and twisted by Wachovia Securities-Homeq. in which they presupposed that they could begin to reissue improper and totally unreasonable eviction notices after this date.)

Wachovia-Homeq., is full of corporate wrath, corporate hatred and corporate greed, especially since they lost to us in a court of law and will do all that they CAN do to torment us and to displace us and my severely disabled mother, to orchestrate an incident where my mother's life is being held criminally hostage by this grave and serious danger. For late on Friday, August 31, 2007, Wachovia Securities-Homeq. issued yet another eviction notice giving us only four full days to move thousands of pounds of life-support equipment which cannot be exposed to warm summer temperatures which would mean the legal equivalent of Wachovia Securities-Homeq. forcing my mother off of life support against her will, which would make Wachovia Securities and Homeq. and any public official such as the Sumner County Sheriff's Office complicit in an attempt at negligent homicide, for the Sumner County Sheriff's Office is ALSO fully aware of my mother's illness, disability and home life-support through the hearing that occurred on July 26, 2007 and even previously on July 21, 2007, when the papers were officially filed staying the eviction with a judge's signature being signed on a weekend, calling for an emergency hearing five days later.

For I will repeat, my mother is a severely disabled person and dialysis patient who cannot be left alone for one moment, and who cannot live without constant dialysis treatment, (much less walk or move on her own,) all of this deliberately orchestrated by underlings in the organization when the manager is out of town, whose name is Jeff Szymendera, who is the Vice-President of REM, so that we cannot stop the eviction from taking place. (For only Mr. Szymendera can stop the eviction from taking its full course outside of instantaneous legal action which could be made on Tuesday, September 4, 2007.)

Since April 2007, a deal has been on the table, one that can be either accepted or rejected. The point being, the offer was never once rejected! And still has NOT been rejected! Yet since April of 2007, Wachovia and/or Homeq. has issued at least six eviction notices, giving a seriously ill and severely disabled person less than one week to move thousands of pounds of precious and vital life-support equipment (for the Peritoneal dialysis supplies are delivered only once a month), all done without acknowledging that a deal IS on the table waiting to be confirmed by Wachovia-Homeq. Servicing!

There are those at Wachovia Securities-Homeq. Servicing who have manipulated our Sheriff's Office, so much so, that even our own justice system has become a clear and present danger to the life of my mother, and me and my father who are her two primary caregivers. Yet we will fight them in court again if we have to, yet there is only ONE more business day to resolve this matter because we just received the eviction notice on the Friday before Labor Day Weekend!

THIS is the evil of the system, where a discriminatory, racist, greedy, callous or sociopathic employee (such as Cathi Lewis at Homeq. Servicing) makes one phone call to a law firm in Memphis, Tennessee, which results with the Sheriff's Office placing my mother's life in grave danger, and with I her primary caregiver (along with my father), who cannot and will not leave her side under any circumstances.

Whoever reads this report, please help. My mother's life, and perhaps my own life, and my father's life are all being held in the most grave danger (as if we lived in the Sudan!) And all because of Wachovia Securities, Kathi Lewis and/or Homeq.

Please write Governor Phil Bredesen, or contact my congressman Bart Gordon, so that my mother's life shall be saved, and never again placed in danger in this or in any other way.
