Household Finacial, HSBC, Beneficial, Advanced Financial Services, MERS. I am currently in the process of losing my home (My Wife and I built) to this or these institutions.My story is similar to many reports I have read. We first got involved with these crooked companies after a cut back in hours at work and a surgical procedure performed on one of my children among other things created a situation where we started to fall behind. A letter in the mail seemed to be the answer to our financial difficulties. Refinance the house and use some of the equity to get squared away. For now I will cut to the chase and tell you these companies worked hand in hand, using deceptive, preditory, and unethical practices breaking every State and Federal Statute that I can find related to Mortgage lending. Like I said,we were having financial difficulties before they stepped in,and if that was what led us to this Hell that my family and I are living and that we just couldn't work our way out of it I could accept that. These people,however,saw to it that we were not going to succeed.I am desperate to find help! We have alot of very interesting documentation that shows what kind of hoopla these folks are whipping up. Why will no-one even look at documents,corespondance,receipts,etc. or listen to the wrong that has been done.

I'm sorry to here that you and you're family are going through hard times now. I would just like to tell you that all though it may seem like it now, this is not the end of the world. Things will get better with time. Do not let this tear your family apart! I know what you are going through and while I don't have any answers on how to keep your house, I will tell you that the love of family and friends will get you through this. Please keep your chin up, fight as hard as you can, and don't listen to the nay sayers and people who think they know what they are talking about (we know the truth!). Hang in there and may God bless you and your family.

With tears in my eyes, I read your post. I am scared and in a bad place/situation with these folks too! Your straight forwardness about inevitability and your Christian resolve to walk away keeping peace and your family intact was inspiring and much needed for me to see. You and Ripoff Report just may be saving a 31 yr. marriage! I realize that the post is dated (old), but the company is still doing business and by keeping this post you (Ripoff Report) are still helping many others in many different ways! Thank you Randy and thank you to Ed Magedson & his Ripoff Report Site! May God bless him for all that he does and the people he stands-up for and may God bless you for your wise words! :-)

The real story is I got involved with a subprime lender who bundled my loan and bet against me. Yes I was late on 2 payments but more than made good on them (late fees etc.). The truth is the lender made sure the loan failed screwing me as well as the investors, but I'm guessing you really already know that. I did not get bailed out like the banks did,and I took my lumps. I stand by everything I have stated. I did Man Up and have moved on, I'm doing well now making a good honest living, can you say the same? The banks need regulation, baby-sitters because they can not be trusted to be honest and forthright. I will also say not all banks are like this. I'm back on my feet and I don't need to be dishonest and unethical to provide a living for my family. Thanks for thinking of me.

People don't want to hear the truth, which is as you said, they are responsible for the current situation and the banks have no obligation to get them out of it or help them in any way.  Why would they want to?  Its not like you are a valued customer that they would want to hang on to.  You can't meet your side of the obligation yet it their responsibility to help you?  And of course when they don't - they are evil, bad and corrupt.  Easy solution - next time - don't use a bank.  When you ask their help to purchase a home, you are in debt to them and you don't own your home until you paid them back as agreed.  So stop with the stupid logic that you are entitled to anything - you aren't.  Man up - take resonsibility for your actions and quit blaming every company in the world for actions (or non actions) that you have taken.  I really hope that this sense of entitlement isn't a characteric that continues to our younger generation.  We will be a country of wimps sitting around waiting for things to change instead of taking actions and making changes.  quit the blaming and take actions ...

The Real Story Is....

You got behind on your payments.  As such, YOU turned on the collections efforts.  YOU didn't like it when they went afer you because YOU FAILED to live up to your end of the contract.  So now, they are illegal...they are liars...they are this and they are that.  Next, you go out looking for some government entity to "help you" to keep breaking the contract.  No government body would do that so now I guess the government is a liar, is illegal and is this and that.  If you had a legitimate case...a case a lawyer thought there was a chance he/she could win (and get paid) then that lawyer would have gladly taken on your case on a contingency basis.  Apparently nobody thought you had a case beyond the lender using contractual remedies to make themselves whole because the borrower DID FAIL to perform as the borrower said he/she/they would perform.  So I guess the legal system is made up of illegals, liars and this and that.

Nothing new here!

Sad to tell you, they got my house. It's almost impossible to fight a financial institution that has more money than some small countries. Also, and I might be peeing in the wind here,but,my state and federal government did not help me at all. It is infuriating to me that I could'nt get any help when I needed a "bailout", but when the big banks need help, the government doles out billions of taxpayer dollars,that is not capitalism,that is crap.

Go immediately to the Courthouse in your County. Find the Deed of Trust from HFC that was placed against your property. Look at the signatures. They are probably NOT yours. The terms of the loan are probably NOT what you agreed to either.

THIS is what HFC/MBNA/Beneficial got caught doing. THIS is the basis of the class action lawsuit brought against them. THIS is what caused the FEDS to get involved. THIS is why HFC et al, plead GUILTY to all counts and paid out nearly $430M in the settlement. Granted, all but about $500/each went to the Attorneys and the States, but it sure put them in a ringer.

I haven't paid on their falsified loan in years, and they haven't even attempted to foreclose. They can't. They know they need proper documentation to do so, and without signatures, they are S-O-L.

Not Again!!

I feel for you and your family. I, myself, am in the process of going through a foreclosure just to get away from this nightmare company!!! They indeed practice predatory lending and feed on those of us who just want to own a home. I have absolutely no regrets on letting them have my home. I am now happy renting and love not having to deal with HSBC, BENEFICIAL OR ANY OTHER AFFILLIATE. At this point, I don't think there's anything you, I, or anyone else can do to this company. They have cost me and my family so much money and heartache, that all we want to do is leave and never look back. I am a true Christian and firmly believe that they will get what they deserve. Obviously not right now, but one day!!! God Bless You!!!

VERIFY THAT THEY HAD A LICENSE TO DO SO
IN MOST STATE THEY ARE LICENSED AS A SMALL
LOAN COMPANY AND ARE NOT AUTHORIZED TO MAKE
MORTGAGES
FURTHERMORE THEY LOVE TO FALSEFY INCOME

Possible Avenues for Resolution

Randy,

We have had a problem with Beneficial as well. I just wanted to let you know of what we are doing, and of what you could do to try and get some relief.

We are currently in contact with a consumer rights attorney in Madison, that has dealt with companies like this one before. My recommendation would be to contact the lawyer's referal service in Madison and find a consumer rights attorney in your area.

The other suggestion that I have for you is to contact the states attorney generals office. Most of the time they are willing to look into situations like yours if you have good documentation of what all has happened. What might be a good idea is to start with your local state representative and have them point you in the right direction. Wisconsin has a pretty good system for investigating and dealing with consumer complaints. The Better Business Bureau might also be another good place to file your complaint.

Good luck to you and your family in your pursuit of justice against a financial manipulator.
