An insured (?) motorist name Rey Reinante rear-ended our car when we were stopped in traffic. There was a car stopped in front of us, and we were stopped as well. Rey rear-ended our car and was given a citation by the police. He admitted verbally - to us and the police - that he was responsible for the accident. We got all the police reports, etc., and, like good citizens, got two quotes to have the car repaired. The quotes were for $2800 and $2300. We took the car to the place that quoted us $2300 to fix it and waited for Rey's insurance company to send the check for $2300 to the auto repair company. The insurance company is Interstate Bankers Casualty company. 4 weeks later, we got a letter from Interstate saying that they would only pay $1000 instead of the $2300 (which was the low quote). How can this be? I then called Interstate asking why they would only pay 45% of the damages, when their insured was admittedly at fault. I talked to Beth Faro and Jane Saunders and both were condescending, rude jerks. They said that we "were partially at fault" even though we were stopped in traffic and their insured hit us when we were standing still. Complete bull****. I even talked to Rey and he - AGAIN - admitted it was his fault. Come to find out, Interstate Bankers Casualty is a fly-by-night, low-grade insurer that -- in most cases -- will refuse to pay for the damages caused by their insured's. And, since they know that most people won't get a lawyer for less than $2000, they screw people on the coverages and they get away with it. They messed with the wrong person this time...we are getting a lawyer to sue both Interstate and Mr. Reinante. How can companies like Interstate not get shut down?

Why? You could do this faster and cheaper by just filing against the other driver (not the ins. company) in small claims court. It's cheap. No lawyer required, and if your case is as cut and dried as you say, should take less than 10 min. of the court's time.
Suing the insurance company won't get you anywhere. It's the other driver that is liable for the damages. He has a contract with his insurance company that says they'll cover his liability, but they are not obligated to you. When you file against the other driver, his ins. company will be bound by their contract to either defend their position that he was not fully at fault, or pay your damages.
My guess is that the ins. company will settle with you soon after you've filed in small claims.
