Mr. Kennedy, for the last 5-1/2 years has been trying to collect monies from our client that our client does not owe him.  Mr. Kennedy had been retained by a client of Mr. Brooks back in 2008 to do some Quick Books work.  Mr. Kennedy claimed he was a Certified Quick Books consultant, which he was not.  His work was unsatisfactory and untimely.  After he invoiced our client several times, and was paid by our client for all but the final invoice, Mr. Kennedy sued our client Landshapes for the balance owed. Mr. Kennedy lost in court (please see attached decision by the judge).

1. Although the court decision was final, Mr. Kennedy continued to seek payment from Landshapes and then when Landshapes did not pay, he started harassing Mr. Brooks who had absolutely no contractual relationship with Mr. Kennedy. 

2. Since then Mr. Kennedy has continually sent threatening  emails and faxes to our Mr. Brooks, in recent weeks on BestofMedia’s letterhead (see attached).  He has also posted numerous defamatory web sites about our client. Mr. Brooks lives and works in Arizona; Mr. Brooks’ client and Mr. Kennedy both work and live in California.  Mr. Brooks has never met Mr. Kennedy.   .

3. In summary, Mr. Brooks’ client obtained a judgment in California against Mr. Kennedy stating they owed no further monies. Mr. Kennedy never had a verbal or written agreement with Mr. Brooks. Mr. Kennedy never was an employee, contractor or client of Mr. Brooks or his firm.  Mr. Kennedy never sued Mr. Brooks or his firm.  Mr. Kennedy sent faxes from BestofMedia’s fax machine threatening to print malicious false comments about Mr. Brooks on the internet unless Mr. Brooks paid his bill.
