Kerber Bros. Pool Plastering, Inc. Owners will not honor agreement and warranty Norwalk, California

In 2000, I had Kerber redo my pool.  I started having a few issues 11 years later.  last summer, I had them come fix the issues as it was out of warranty.

One issue in the spa was serious, the pebbletec was breaking down and they had to remove all the pebbletec and redo the spa step and gunite once again.  No problem, it was out of warranty so I paid them.

I had them also fix cracks in the wall of the spa where the tile was separating as well, it was the same problem, they had to remove the tile on the dam and clean out all bad gunite and retile the dam.

Rocky, their "brilliant" supervisor gave me the bid and said they would take care of the cracks gunite etc in the total cost of the spa repair.

It is now 11 months later.  I called Mr. Brilliant (Rocky) on his cell.  He didnt remember the job.  He said he would get the paperwork in the morning when he got to the office, a few minutes later he called and said, "I have no record of us working at your house."  to make a long story short, I had to fax him the contract as they did not have it or could not find it.  So the next day he comes to visit and see for himself what the issues are.

Mr. Brilliant says "I remember this job now".  I thought great!  I then showed him the cracks in the dam between the tiles and told him the same thing is happening.

Mr. Brilliant says:  "We didnt fix that wall".  I said really?  So you are telling me you gunited my steps, put in new pebble tec and stopped at the tile line.  "Yes" he says.  Then he said, "show me where it says on the contract that we are doing the tile and fixing the dam".  The contract does NOT state that they would be doing tile work.  However, they did the whole job.

Mr. Brilliant goes on to say, "you hired someone else to fix the dam and do the tile".  I said, are you kidding me, I am going to have you fix "half the spa" and bring in someone else to do the same work in the same area".  And yes that is his contention.

Then I start calling the owners.  Kip, and Lisa have at least 5 messages from me over 6 days, no return call and this is under warranty.

I will take this to small claims court, it is the principal of the matter now.

And to all others, after this issue I began looking up other issues iwht Kerber Bros and there are way too many to consider ever using them from the BBB to just internet misc complaints...they are not honorable people.
