Malek Management I paid rent and security but i didn't get the apt nor the money back! Brooklyn, New York

I was looking for apartment to rent, i looked and i found a nice ad for an apartment,  i called and the got an appointment with the real estate of the company who own the building. i meet this in front of the building, he had a keys for the building and many apartment too, he saw me two apartment.

The 1st time i see the apartment there was tenant in it and they know the real estate (Mark), i liked the place and i paid 2 month, i went to see the place again 2 times to choose the color of the walls and ask for some repairs.

when the date came for me to move i went and found someone else living in the place, i called the company to get my money back they told me we didn't took any thing from you, (they said) your problem with Mark he did that with 40people and took money from them, we will make him call you (they said) than he called me, after the company told him to call me he said he will return the money  than every time we talk he said next week, tomorrow, after 2 days.

I been waiting for a month and i only got 1000 back from total of 3340. not sure what i should do, i went to lawyer but he say the amount of the money it too small to sue them!
