Merchant Lynx comes in. Two individuals; main Acct Mgr Tim Nardini and his protege Adam Mills. Alot of talking, alot of good tag team selling, but not being up front about costs and 'contract' you are signing.

1) They come in regarding merchant credit processing services. Since we have no 'store' there is no need to hardware and this was stated SEVERAL TIMES.

2) The first 'contract' was trashed because it included the hardware. So we get another contract going for the services only. Unbeknownst to us, the first 'contract' is the one that gets sent to First Data Global Leasing, and this locks us into the hardware 'contract'. Also fees for 'insurance' on the hardware.

3) Guy shows up to install hardware. We tell him emphatically that we did NOT order hardware and send him away.

4) Nardini comes back in and argues over the legalities of the 'contract' and that we agreed to the card processing machine. We argue. The CARBON COPY contract we have, does NOT include hardware. Nardini simply states that it is non terminating 'lease'. At this point, we do not have any hardware as it's been sent back. Nardini also comments that Adam Mills has been terminated for 'falsely selling contracts' when the customer was not buying a 'contract'. I think he was simply the scapegoat.

5) At this point (being billed for a service and machine we are not using nor have), we stop payment on the debit at our bank and start refuting charges.

6) I call Merchant Lynx and argue with them regarding what was signed and agreed to and what wasn't. They tell me to call First Data Global Leasing. I call them, they tell me I have to talk to Merchant Lynx. We call Merchant Lynx back, very rude. I ask for the manager, they give me Nardini's number and I call him, leave a msg. He calls back and starts arguing when I have the contract right in front of me. He is getting very irate ("do you want a copy of the lease"?). No we have one, and it does NOT include hardware and in fact we signed the WAIVER stating no hardware. Still arguing with us.

7) Today they fax us a copy of the 'contract'. It was the first one that was supposed to have been destroyed after we told them NO to hardware.
I am writing them a letter, reporting them to the BBB and sending a copy of the letter to the GA District Atty and the FL District Atty. I have not spoken to Phil Beniamino although I'm told this is Nardini's boss. So the letters will be addressed to him as well. I'll let you know how we make out.

Belinda, We have done every thing in our power to try and help you and your husband Donald, When we went to court on this matter October 7 /08 and the courts favored in "Merchant Lynx Services" favor under a court of law, we opted to sign a new lease with your company so you would not be hit with the fees that your company had accumilated over the time that the lease was not being paid. Please stop sending in bogus complaints about Merchant Lynx Services, We allready went to court and appeared in front of a judge and was awarded a judgement against your company, Unless you feel that the Judge of the court was wrong to. If you need any help with your account please feel free to contact our customer service dept.

Very unhappy with Merchant Lynx Services, First Data Global Leasing, Ipayment, Mtot.

Tim Nardini took me to court 10/7/2008 because he said the contract signed is non cancellable and the owners of the leasing corporation wanted the machine and money back.
I received a copy of notice to appear on 10/2/2008.
I sent the machine back August 2007 last year however they lied and said it wasn't received. They forced me to sign a new contract.
I hope the investigators do a surprise visit to 1307 Walt Whitman Road Melville New York 11747 address with a search warrant to see how deceiving this corp.
I called Federal Trade Commission and filed a report. I have other government authorities to contact as well as an Attorney.
There's a 3 days to cancel policy that was violated since Tim Nardini called/ solicited me, then he's suppose to let everyone know this and give them the form. He did not do that for me.
MLS 866-873-2200 number is for Annapolis Maryland.
The BBB here in West Palm Beach, FL. said I have to file complaint there.
10/13/2008 Tim tried to get me to use my personal account number for payments.
The original contract was for Headlights Pro and it will stay that way.
Be very careful These are some real con artist.

Don't take delivery

You got the shaft on this one... The salesman is getting good commissions on equipment and it is likely the lease payments are also higher than industry norms so he has a lot to lose. Also because the terminal was sent to the agent and not to you, the leasing company shows the lease is delivered. If the terminal was sent to you and you refused delivery (didn't sign for the package and sent the UPS guy right back out the door without taking delivery) then the lease would be canceled as soon as UPS returned the package under the same tracking number. In this case, the agent took delivery and is bringing you your terminal. Technically in this case as long as you don't take delivery of the terminal, the lease is not legally fulfilled. The agent is actually most likely liable for the terminal and will have to buy out the lease himself... that's why you're getting the push back.

The Saga continues with Merchant Lynx

Here we are again. I thought this had all been sorted out, Merchant Lynx came in and we signed a new agreement. However, now there are four or five charges EVERY month that were never mentioned in the contract and in fact, I specifically told them we were NOT going to pay.
iAccess Fees $9.95 - twice per month
Bankcard Mtot Disc (no other description) $30.00; $30.20; and $37.95 each month.
All this on top of the monthly 'rental' of the unit. I am definitely in the wrong business!
I have asked Gena (I think) four times now to have the charges credited to our bank account. So far, only the $9.95 amt's have been credited. So I will let you know what happens from here. Stay tuned.

I would think with these dirty practices, they would be out of business by now but I honestly believe that most don't realize these charges are even coming from Merchant Lynx....or too busy to keep up with pestering them to stop and/or credit the amounts back.
Anyone know of class action suits?

That's why I dumped 'em after 13 years. It started going downhill when they got bought out by RBS. Referred a couple of new businesses to my old rep. Once I found out how she was trying to d**k them over, I stopped. They were getting as bad as transtec with all their fees. There ought to be something you can do about your situation. You have the first contract, then a second contract. Tell them If they keep it up, you're gonna contact an attorney. IF they still do, go ahead and contact one. Make sure and send all mail certified.

Merchant Lynx - Update

Following printing out pages of the bad reports on Merchant Lynx, sending a scathing letter, we were called by Gena who is Mr. Beniamino's assistant. She was very helpful and they are supposedly returning the charges to our bank account. All in all, I'd say (even though it took getting nasty to get there), Merchant Lynx came through.

I hope you all have the same satisfactory resolution.
