I have been trying to get a home for my family and when I got my Credit Report. I found out that I had an outstanding bill with Midland Credit MGMT. I know nothing about this bill.
I called this company and they told me that I owed them a bill for a car that was repossed. I told them that I have NEVER had a car that was repossed.
I told them that the car in question was returned to the car dealer before 30 days after I bought the car. I also told them that the was broken down. The car dealer told me that because it had not been 30 days from date of purchase that it would be alright. They would take car of this and it would show up on my Credit Report. THEY LIED and turned it over to MIDLAND CREDIT MGMT. 4 yrs. later.

Others don't want to touch it. Some states have a statute of limitations on collection as 4 years after default, New Jersey has a 6 year statute, for example.
Attempting to collect on a SOL debt is illegal under the Fair Debt Collection Practices Act and carries a $1,000 fine per violation. Be careful and don't speak to them by phone.
They are notorious for various illegal tactics including illegally reporting expired debts that they buy as current and 120+ days past due every single month, which means that no one will grant you a loan or other credit because if you are 120+ days late on an item on your credit report that looks legitimate - regardless of whether it is, since they can't tell - your credit score drops significantly and stays low.
Their intent is that anyone wanting to buy a house or get the notation of their report for any reason, willjust pay them to go away because they will not remove the item from a credit report otherwise, illegal or not.
I have a close friend who disputed their item with Equifax repeatedly until she finally had to sue them to remove it. She had about 40 different FDCPA violation on them by then. Midland Credit Management is a very difficult outfit to deal with because they have no interest in being legal.
They are part of Encore, a billion dollar company and they are publicly traded and,not surprisingly, extremely profitable. Check out www.artofcredit.com, www.bayhouse.com and www.creditwrench.com for good info & background.
