At the writing of this report, my husband and I are being sued by one of our creditors. They have requested a judgment against us from the court, and we are left to handle this without legal representation. I wish I had listened to my gut instinct in the first place, and never bought into this apparent "scheme" by Nationwide Asset Services, whose representative "promised" that we would be in good hands, that they would lower our interest and remove fees and penalties through negotiations with our creditors. Originally, I turned them down. But they continued to call me and making me feel like I was stupid to not want to lower my interest, etc. (his exact word's were "why would you not want to lower your interest to possibly zero, and avoid penalties and fees?").

I did everything they told me to do-had my phone number changed (to avoid harrassment by my creditors), gave them power of attorney over the debts in question, and worst of all, gave them the right to take money from my bank account every month.

After nearly 3 years of deducting $300.00 monthly from my account, the only settlements they have done successfully were small accounts to credit card companies, of which they saved me absolutely nothing, after taking into consideration their up-front fee of $400.00, monthly administrative fees of $49.00 and bank maintenance fee of $7.20.

Now, we are being sued by our largest creditor (in the neighborhood of $15,000.00 including interest and court fees). Meanwhile, Nationwide Asset Services act as if we have nothing to worry about, that this is, more or less, "par for the course". I don't know at this point what I should do about the money the continue to take out of our account every month, if I should put a stop to it, and demand what monies they are holding, or see if they actually are successful in negotiating with our creditor (if the court sees fit to honor my request to not grant the motion for judgment against us).

I don't know how this mess will play out in the end. But I do know that our credit is virtually destroyed, and we are now looking at the real possibility of going to court over this. This is scarry stuff, and it keeps me awake at night with worry.

I have an interesting update to my previous complaint against Nationwide Asset Services (aka Global Client Solutions and Specialized Funding).  My husband and I did file bankruptcy, and I filed several complaints against NAS with various Attorney Generals, including those for Arizona and Indiana.  In response to the complaint filed with Arizona's Attorney General, I recieved an offer to settle from NAS lawyers. After careful consideration, I decided to accept the offer (which, by the way was only a portion of the fees we paid).  Something, I felt, was better than nothing at all so I contacted their lawyer and accepted the offer.  Over the phone, the lawyer had me quote to him the amount I was accepting as settlement, which I did do.  Now, it has been well past 4 months since the phone call to NAS attorney, and I have not recieved the settlement that was offered. So, again I have complained to the Arizona Attorney General (Terry Goddard).  I am so disgusted that this company (aparrently) gets away with their practices, and am now at a loss as to my next move.  I certainly can't afford a lawyer to fight this, but I hate that it looks like NAS will most likely get to keep the money that they, i feel, frauduantly obtained from us and others who can least afford to lose it.

My husband and I incurred a judgment against us about a year ago, from a suit brought on by one of the creditors that were included in our agreement with Nationwide Asset Services for debt arbitration. In June it will be one year since we had to file bankruptcy. Since that time, after obtaining credit reports we discovered that the credit card companies that Nationwide Asset Services supposedly paid off were, in reality not paid at all, and we had to have them included in the bankruptcy. We did recieve the monies that were being held by Global Client Services/Rocky Mountain National Bank, but that was just a small portion of what we paid into our "plan", and of course the start-up fees, monthly bank fees (etc.) is money we may never recover.

I would be VERY interested in being a part of some class-action suit against these people. They pursued us, obtained our trust, and then proceded to take money from us that we could not afford to lose. We are devastaded by this, and there seems to be no end in sight to our financial problems.

If a creditor is suing you for $15000 you should consult with an attorney immediately!!!

This lawsuit against you will NOT be small claims court and if they get a judgment against you then they can do all sorts of things such as;

garnish wages,
levy against bank accounts,
levy against state income tax refunds
lien against your real estate,
lein against any property of value, such as car, boat, RV, etc.

Don't waste another minute! You need to consult with an attorney right away!
Bankruptcy may be a viable option for you.
