Beware of NetSpend when buying gas at the pump using your NetSpend Credit Card. They unlawfully take much more than your purchase and then "under the color of law" they state that they will have it returned on your card within two business days; thereby gaining interest that they keep (even if you ever get that excess amount that they took back on your card.


I purchased $10.50 in gasoline and $56.00 was taken off my card. I called Net Spend and they stated that it is normal procedure and it will be back on my card within two business days upon the store verifying the amount. Well i called the store and they had verified the purchase and i called NetSpend again (and this is on the second day) and was told it would be bback on my card; which was not accomplished; additionally i was given 3 different time frames, the first one being 24 - 48 hours, the second being 2-5 business days, and the third being a guarantee of being put back on my card the day i called which was the 48 hour time frame.


It seems as if the correct authority to handle this issue would and will be the State Attorney Generals Office.

I was informed of the information in your rebuttal and i have always made it a working habit to cover all bases in situations such as these, which is why i took the initiative to verify such issue with the merchant, and funds were verified almost immediately and they no longer had a hold on them; thus they obtined the $10.50 purchase amount of gasoline.

This issue being presented is just another example of a company running wild and utilizing such business practices to justify "constructive theft".

If an individual "small business" operator were to engage in such practices, such business owner would be charged with a crime immediately.

This is standard.  When you pay-at-the-pump the merchant, not the bank, places a hold on the account for an estimated amount.  This varies by gas station, but is generally between $50-$75.  Once the actual amount is submited the "hold" is supposed to be removed as well.  However, just like the amount that is held, the amount of time this takes to be removed also varies.  It can be anywhere from the same day to 10 days later.  But in most cases it is generally between 2-5 business days as they said.

To avoid this in the future you need to go inside and pay for a specific amount.  This way there is no additional hold put on the money.

Also note that this can apply for other places as well.  Such as Hotels, or Car Rental Agencies.  Now, VISA or Mastercard does not allow an over-authorization on resturant bills.  But if you do something like open up a "tab" at a bar that is also allowed.
