I signed a contract with NUHOME Denver on October 23, 2014 for a kitchen remodel, hardwood flooring, painting the kitchen, den and living room.  I was working in Atlanta, GA only coming home on the weekends, primarily to see the work done by NUHOME Denver.  Therefore they had more than enough time to finish the job.  After 3.5 months I gave an end date of February 6, 2015 or I would take them to court and post reviews all over the Internet.  I thought that might motivate them.  NUHOME Denver’s owner Eric sent an email saying my punch list would be finished by February 6, 2015.  This was hardly a punch list.  The cabinets did not have doors?  Between January 31, 2015 and February 6, 2015 the only thing done was his removal of their tools.  I called, emailed and text Eric however he did not answer his phone, respond to text messages or emails. 

Since I was working in Atlanta during the week NUHOME Denver thought they could take advantage of me.  My home was the last on their list.  The weekend of December 6, 2014 through December 8, 2014 I was told my hardwood floor would be installed.  Attached are pictures from the first install of my hardwood floor.  Obviously they had to install a new floor.  And instead of using a shop vac they used MY 499.99 Dyson Vacuum to clean up their mess from laying the floor.

Since I was working in Atlanta when I came home my house was an absolute disaster.  I did not mind the inside of the house being a mess but my neighbors did not care for the look of the outside.

I told them it was very important to have everything completed by Christmas (December 31, 2014) because my family was coming from South Carolina and Texas to my house for Christmas.  Attached is a picture of how my family and watched movies while they were here during Christmas, on paint buckets.

Eric handcrafted the cabinets since I do not have all the cabinet doors and no drawers it is going to cost a small fortune to have them finished and the refinished cabinets may not look alike….

As of January 16, 2015 after hearing my place would be finished by January 30, 2015 I gave NUHOME Denver a check for $4,997.40.  As of January 16, 2015 I gave NUHOME Denver $25,536.65.  As of February 7, 2015 you can see how my house looks.

I can rebut everything stated in Mr Yinglings rebuttal except the nasty emails. I certainly did write the emails because I was mad as hell and sick of going from my Atlanta hotel room to a disaster of a house. For example Mr Yingling stated I did not pay my first installment until November 14, 2014. I gave he and his former “partner” a check for $1,249.35 on 10.25.14 as stated in the contract. I have a picture of the cashed check however I don’t think it is a good idea to post checks to the Internet.

As of February 28, 2015 Eric Yingling owner of NUHOME Denver has been paid for everything related to our kitchen contract except for $1,249.35 “due upon full completion of contract.” However I am missing ALL cabinet drawers, some cabinet doors, all cabinet handles, the microwave cabinet, the oven hood is not completed and the kitchen molding is missing.

After my ripoff report rebuttal stating, “let’s see if NUHOME Denver completes the job at my house.” I received this email…

Hey Michael,

I want to apologize about the situation. I am in Chicago for a family member's funeral and get back Sunday am. I will have your house finished by Friday on everything thats on me. The only things maybe not done will be painting the house doors (but we have that price in the change order and the actual work is out of my control).

I will give you more detail when I am back at my pc.

Nothing was done at my home after this email. I tried calling, emailing and text messaging. There was no response. I have given up. My only reasonable recourse is social media. I don’t want to see anyone else get Ripped Off by Eric Yingling and NUHOME Denver.

This has been quite a learning experience, an expensive one. If you want to do some remolding do a lot of research and find every review possible. Make sure the person has been in business for a good amount of time. Make SURE the contract has DEADLINES and hold back on a substantial amount of payment until all products are onsite. Finally watch the people like hawks and don’t give them free reign of your house. Don’t get screwed like me….

Your current punchlist is fine.  "Widen lower fireplace tiling/grout hearth/add bullnose as discussed."  Have everything done by the February 6, 2015 and give me a bill.

As I stated after 3.5 months I thought my actions would motivate NUHOME DENVER.  That did not work.  Therfore on February 6, 2015 I wrote "Please just finish your job in a reasonable amount of time."  

On February 8, 2015 NUHOME Denver's Eric wrote "I would still happily complete the job per our contract (as my e-mails to Mr. Brice confirm that), but I will not be scared or black-mailed by personal, legal, or other threats nor will I force my employees to work under duress or in a dangerous situation."

Please come finish your job at my house in a reasonable amount of time. 

At the end of the day let's see if NUHOME Denver completes the job at my house.

Mr. Brice is correct that he signed the contract on October 23, 2014 to begin work on his home. What he doesn't mention is that I was in constant contact and helping him plan the entire project starting from his initial contact in July 2014. Going far out of my way and making multiple trips without even knowing if he actually wanted the work done just to try and help guide him into the best decisions possible. Once we had a signed contract, we immediately started work per the terms of our contract in October. In our contract it was stipulated that a payment would be due after the first full day of work which would cover our inital payment and flooring materials. That payment was not received until November 14th, 2014. I (and my contract) reminded and pointed out that just as he expects us to work per our agreed upon schedule, I also expect to be compensated per our previously agreed upon schedule. 

What Mr. Brice leaves out is that during the course of the work he signed an additional contract to do his fireplace. This would, of course, extend his timeline and I did notify him before signing that I had prior familial obligations and would be unavailable from December 19th until January 2nd, and that adding this project (amongst the many change orders that I knew would be inevitable) would most likely cause us to run over. The punch list he is referring to that I did say could be completed by February 6th does not include the changes that he (again) mandated Sunday, February 1 and demanded that not only the existing punch-list but also the new work all be completed by February 6th or else I was going to be sued. Between January 31 and February 1 I received 4 e-mails that were incredibly vulgar and profane as well as containing multiple threats to me and/or anyone affiliated with me. I had previously told Mr. Brice that continuing to harass and threaten myself (and my workers) would result in a jobsite halt and no further direct communication from me. It was at this point (Feb 1) that I decided the best course of action was to immediately halt all communications with Mr. Brice and turn the matter over to my legal team in Denver for actual legal advice. What Mr. Brice does not include in this false accusation is that he is in breach of our contract in multiple areas, has nearly doubled the original scope of work from our first contract (all via signed additional contracts and change orders), and continually would be very pleased and happy in person and then would flip and send terrible e-mails all weekend. Here is an example of one of the 7+ recent e-mails received from Mr. Brice all during the Jan 31-Feb 1 period:

"Where the h*** did you get this thing?  First time I used it and it came apart?  If I use it on hot the the apparatus is stuck under the granite?  I contacted an attorney.  If all this s*** is not fixed and you are not out by February 6, 2015 we are filing a lawsuit.  

 
I feel I have been totally F***** in the A**!!!!"

The sink he is referring to was specifically picked out at Home Depot and the exact model number named per our contract addendum that he chose and agreed to. The sink was installed and operational prior to December 24th, 2014 with absolutely 0 complaints. Per my better judgement, I did reply and indicate that if the sink was faulty I would absolutely repair/replace the unit at my cost. 
 
The floors Mr. Brice references were infact poorly done by someone working with my company while I was gone during the aforementioned holiday period. As soon as I saw the photos I immediately took time away from more pressing familial issues and e-mailed & called Mr. Brice and assured him that I would (at my own cost) completely tear out and replace the floors to do my best to make him a happy customer--but that it would require additional time and patience. I also offered to do extra upgrades on his property after he was satisfied as a mea culpa. He was understanding and okay with this and agreed to it in writing. I did not personally ever touch his 499.99 vacuum. 
 
As far as the fireplace goes, that photo was never something that was "promised". I did not supply his fireplace mantel (which was supposed to be delivered by mid-November but showed up January 26th and had to the very first piece installed and was holding up the entire job). It was completed exactly to our contract's specifications. When Mr. Brice later expressed that he wanted the bottom & top widths to be the same, I said I would go ahead and re-do whatever was needed (again, at my own cost but it cannot happen overnight as the stone had to be shipped in which takes a few days) to please him on January 30th when he saw it in person and I made the extra trip at 7pm on a Friday to meet him and discuss a few questions I had on finish work. On February 1 he again demanded that this work be done ON OR BEFORE February 6th or I would "be sued". He did not care that the tiles could not be acquired in time to make that happen. 
 
In reference to Mr. Brice's cabinetry, he was informed multiple times that I was keeping the doors and drawers off while painters, tilers, electricians, and plumbers were all working in the kitchen due to the extremely high risk (and occurance) of them hitting the brand new finished cabinetry with tools/mud/thinset and ruining them. The cabinetry was on-site for him to see finished since January. The same for the picture of the bullnose tile, he conveniently snapped a photo of something unfinished because I had specifically stopped there to ask him what his preference was (because we had 3 options) before moving forward. I sent him updates on his property every 2 days with pictures and a brief rundown of what was accomplished and what we ran into. My levels of communication were above and beyond just because I wanted there to be no question that I was going to do everything I could to deliver quality work and make him happy. 
 
Finally, I will end with an e-mail received on February 6th @ 10:26 PM (meanwhile, this "Ripoff Report" was filed less than 24-hours later before I had a chance to even respond to his e-mail). This was after Mr. Brice said to clean our tools/etc off the jobsite (prior to the Feb 6th deadline that even he claims--even though this deadline was never agreed to by me as I know that would be impossible with the acquisition of materials for extra work he wanted done for free being impossible).

I apologize for my thoughtless emails and text messages.  As my father stated my job in Atlanta has been extremely stressful.  I believe I told you that.  As I have stated in the past, myself and everyone who has seen your cabinets, which is your forte, really like them.  I promise I won't post anything on the internet, if you want you can post pictures of my place on your webstie, etc.  Please just finish your job in a reasonable amount of time.  It has been difficult dealing with my bats*** crazy job and coming home to an unfinished house.  If you finish the job as you promised I will throw in some extras for you.  

 

As I have said in the past my father and I greatly appreciate your service as a member of the US Marines.  Which is the main reason I hired you.

This should further illustrate that something is not right when I am getting an e-mail like that and less than 24hrs later I have falsified "reviews" popping up all over the internet.

 

For the extra hassle, I had thrown in a bunch of extras to include: hiring maids to clean his enitre home (not just where we worked), painting the ceiling of his entire home, repairing holes in the drywall that were not originally agreed to, having my master electrician do a thorough check of the previously done by homeowner illegal wiring and fixing any severe safety issues at my cost (of which there were a few), installing a new hallway light, repairing his modified front porch light that malfunctions, installing a mantel on his fireplace that was significantly more involved than our original contract stated and supplying the extra installation materials at my cost, repairing a faulty outlet in his dining room that had live wires dangling in insulation, repairing his ceiling fan that was incorrectly installed and wired, installed an in-wall behind the fridge ice-maker supply and box, installed under cabinet lighting for just the cost of materials, and upgrading his floor vents to wooden oak ones to match. These were all completely outside the scope outlined in our contract but were just some of what I did to attempt to alleviate some of the frustrations of the job for him. I doubt someone "ripping people off" would spend significantly more money and time trying to give free upgrades.

 

In closing: I take my small business and my work very seriously. This is how I earn a living and I am proud of my finished work. I am an honest person (and luckily have plenty of verified references that would be more than happy to explain their experiences with me/my company). Most importantly, I never have/never will rip someone off. This is remodeling construction, sometimes something unfortunate happens but I will always stand behind my name and do whatever is required to make it right. The only thing I won't do is continually expose my employees, subcontractors, and myself to the verbal abuse and aggressive threats such as those received from Mr. Brice. I would still happily complete the job per our contract (as my e-mails to Mr. Brice confirm that), but I will not be scared or black-mailed by personal, legal, or other threats nor will I force my employees to work under duress or in a dangerous situation.
