We found this company on my credit report and noticed the date. During this time period, we had an account with Verizon Wireless and therefore, didn't need an AT&T Wireless account. We have called AT&T and they have no record of this. So, for about a year a half this company has put a negative mark on my credit.

I recently ordered my credit report and it say that the status of this account was verified and updated on October 2005. It never happened! I called the company and was put through a voice mail service. I wonder if I will ever get a call back. I will keep calling to have this removed, but until then I have a negative mark on my credit report.

At this point you are already being sued. If you do not respond, they WILL get a default judgement against you.

However, if you DO repond PROPERLY, they usually drop the suit and go away.

In your response, you need to be very specific that this debt is not yours, and you need to DEMAND validation.

This would be a motion of discovery to find out before trial what evidence they have to support the lawsuit.

Demand that they provide something you signed to create the alleged debt, and an account history.

DO NOT give them any personal information like SS#, DOB, or employment info as they may not have it already.

Do all communication in writing by certified mail, return reciept requested.

What can I do?

Would it make a difference if It's a letter stating that they are gonna sue or if it is the actual letter from the court, telling me that I need to file an answer?

I received a letter from the court stating that Pressler and Pressler are suing me on behalf of Palisades Collection Agency and that if I don't file an answer then a judgement will be entered against me.

The account that they claim I owe is from 2002 and I have no clue as to who the company is, not only that it isn't listed on any of my credit reports under the original name of the so called creditor "HOUSEHOLD BANK" or any other company.
I am NOT prepared to have Pressler and Pressler levy any of my accounts or garnish my wages for an account that I know nothing about and is NOT on my credit report. And 2 top it off speaking 2 anyone there is pointless, they are rude and nasty.

I haven't even received any other correspondence from Pressler and Pressler before they sent the letter to sue.

Mary,

AT&T sold that debt. Pressler and Pressler are lowlife debt buyers.

They bought that debt for next to nothing, and the file was incomplete. That is why everyone with any variation of your name is probably getting that letter.

HOWEVER, if you do not respond, they WILL get a default judgement against you.

This is what they count on.

Most collection attorneys could not find the inside of a courtroom with a guide dog! If they actually knew anything they would be doing trial law instead of collections.

They are just parasites.

Send the request for debt validation by certified mail return reciept requested. Specify that you dispute the debt and DEMAND to see proof such as a contract you allegedly signed and an account history.

You will not hear from them again.

Did they actually file the lawsuit yet, or did they just send you the classic intent to sue letter?

Huge Scam

Paula,
I completely understand what you're going through, I've been having the exact same problem with them. Instead of just letting it go, I called and called and left message after message. Needless to say I never received a call back or anything, instead I'm being sued noe by another company AT&T hired. Be extremely careful because they are the biggest scam artists. If you get a letter from a company called Pressler & Pressler, make sure you call them and have all the documentation proving your side. Unfortunately, I have to go to court to settle this scam.

Paula:

Don't call these guys again (it's hard to prove a telephone call). Instead, do the following:

Send a letter via certified mail return receipt directly to Palisades (address should be on your credit report). Tell them that you noticed that they had listed an account on your credit report(s). Tell them you are disputing the debt in its entirety. Request that they send validation of the debt within 30 days to your address.

Then a few days later, send a letter to the credit reporting agency disputing the debt. Tell them you never had an AT&T account.

Since the debt is obviously not yours, what SHOULD happen is that Palisades won't be able to prove that it's yours, and the credit reporting agency will have to delete the tradeline within 30 days of your dispute because Palisades can't prove that it's valid.

But, Palisades could very well decide to ignore you and re-verify the account.

If this is what happens, make at least 2 more attempts at the previous letter-writing campaign (to prove that they willfully violated your rights despite numerous complaints). Then make sure you gather up copies of all of your correspondence, mailing receipts, and credit reports and show them to an attorney specializing in consumer law/debt collection law. You can find one locally at NACA's website.

At that point Palisades would have committed violations of the Fair Debt Collection Practices Act, the Fair Credit Reporting Act, as well as your state's debt collection laws. They will then be responsible for paying statutory, and possibly punitive damages, as well as your attorney's fees. Defend yourself and your credit score from these guys.
