After a time, it seems dignified to respond to claims about lawsuits.

Back then, in 2007,we felt it better to let sleeping doge lay,
as it were. As I am sure any reader will understand.

The lawsuit against myself and Gold Calling brought by
Connie Smith was dismissed a long time ago, more than a
year and a half back now. She never appeared in court,
did not file to reinstate the legal action and it was therefore
dismissed without prejudiced by the small claims court in
Hamilton, as it should have been.

The mention on this site of an INTERNET PORTAL was a website
and system that was more or less a copy cat of our system
that was started by TOM and PAM and perhaps others.
I beleive they got a rude awakening to how difficult it really is to
write software and maintain websites but that is another issue.
The point is they were nothing to do with me when they decided
to launch a "me too" system that apparently had issues.

Connie lumped us together, showing that she was suing me,
that TOM and Pam briefly promoted my products and basically
trying to present guilty by association, which left her open to
damages by me and possibly the other two as well. I felt
it prudent to let it alone.

Anyone wishing a copy of the dismissal can look up SMALL
CLAIMS COURT in HAMILTON, ON and order it.

Thank you and I trust this clears up the issues, at least from
my perspective. Every reader should also know that I still support
the software even know, more than 4 years later (from the date
Connie ordered it).

Give me my money back, with interest and lawyers fees.

Also repay all the other class action litigants.

There are two things I want to say in response to this RIP OFF report, the items in question;

1) It seems to start off talking about Pam Bennett and Tom Khalsa and a website that was promised. Then it mentions that they are or were involved in Gold Calling, using the exact words; "working with another scam artist"

2) I also saw in the thread that Connie, the girl from Nova Scotia who started the thread mentioned she was taking me to court.

ANSWERS

A) In is unclear what website Pam and Tom were oferring and, I cannot make a comment about this software at all. I know Pam operated a website that worked impeccably but this referance may have been to another venture she attempted, I cannot be sure.

I do know it is a lot harder to try and build something than it is to slander it - it takes guts to try, it takes no guts to slander those who tried.

Trying and failing is not the sign of a character flaw (or a rip off artist for that matter, unless it was intentional meaning that person did not intend on doing as stated. And this is not a description of the Pam Bennett I know). Not trying, however, most definetly is.

B) I want to confirm that Connie did start a Small Claims court action against me. She did not show for the first hearing, which is not surprising. She also apparently has wrongfully accused Pam Bennett of being a part owner of my business, which is not true.

Connie - I say this now - I have sent you emails as recently as last week where we oferred once again to support you. And I even made sure that yoiu knew that offer was to have someone elwse call you adn not me, as you rather obviousely have a problem with me personally.

Your claim that the software did not work seems of odd indeed since the court documents (public record) show your computer hard drive failed and you had all kinds of computer problems in addition, including loosing everything on your computer. These are words you written & submitted to court by you.

You refused my ofer to call you personally to explain (this was in October of last year). You refused help from an individual I had call you in November of last year.

And, at this point in time, you appear hell bent to extract your pound of flesh rather than applying yourself to getting what you paid for reinstalled & using it. In other words; instead of building your own successful business you weould rather try and spend a considerable amout of time tearing mine down.

I relish the chance to meet you in court and prove everything I have said and more to be true as well as to speak clearly and say in a public forum that every offer I ever made you is still available to you. You have lost nothing, only time & this was a self imposed sentance (as well as a computer failure).

The only thing I regret was trusting you to be the type of person who would apply herself rather than scandylize me, my company & my product.

This forum is a place where you can state what you believe. It is also a place where I can rebut that statement or my users. The fact that a rebuttal by a happy camper with our software caused you to type "shut up' in a post shows that you are a a person in pain. And, while we feel for you, we are not reqauired to like the slanderous nature of your actions.

In 2004, these people sold a non existent web portal business to at least 60 partners in a business called Jumpat. They charged each person $5,000 to $20,000 for their turnkey, fully operational business and search engine portals.
That's 1/2 million dollars!

No portals were ever completed. No refunds were given. No guarantees honored. These people just disappeared and started new businesses with our money.

These people brag about how much money they are making with their Goldcalling business now. ( Steven Burke, owner, is also a crook. He sold us software that never worked. He's summoned to court, now)

In the summer of 2004 I was Introduced to Pam Bennett & Tom Khalsa business opportunity "Jumpat Internet Portal" which promised to make us a substantial return on our investment. Talk about con of cons. We parted with $5,000 but know of others that lost up to $20,000.

There was no Internet Portal and they were trying to make it up as they went along. My estimate, over 60 people lost their money and a few lawsuits were filed. It was a nightmare to say the least and I was stunned by their blantanly lies.

Here are list of programs that I'm aware of that they have been heavily involved in - Eventis, Coastal Vacation, 1 Up Automated, Digital Response, GoldCalling, A Foreclosure company (I forget the name because it was only around for a few months)and Porno websites. They will sign you and make a ton of money then jump to the next program and leave you stranded.

There Ex Partners Jeff Mills & Tom Tisilonis will have nothing to do with them. I have spoken to both of the at length and they have nothing positive to say. Infact Tom Tisilonis paid dearly for his involvement with them.

As a spokesperson for GoldCalling, don't be fooled by Pam's sweet innocent sounding voice....she's a viper and will cut you down without a second thought. As for joining GoldCalling, do your due diligence because it will be here today and gone tomorrow. The complaints to the feds are pouring in...do your homework folks.

This woman seems to have had a bad experience with all of the parties involved only saying negative comments and not saying why she got involved in the business. And, she never listed the expectations. If she was sold something where she had felt the product or persons involved services were not delivered upon she would have a better leg to stand on. She is clearly not stating the facts in either case. I have done business in the past with all of the parties involved which are spoken against and I have never felt that these individuals have let me down or the people I have introduced them to down, when it comes to business. Clear expectations were set, I agreed and I have a product that I have been using for quite some time without flaw. These individuals (not the woman) have been nothing but professional going above and beyond what I expected. It is a shame that their names must smeared in such a fashion. I equate her complaint to the service providers selling her a stick of gum, she chewed this gum and bit her lip and now she wants to sue the gum manufacture and the persons who sold her the gum. When is this going to stop, which distributor will fall victim next, this madness has to stop. I know with great certainty that Pam and Tom have a great customer satisfaction rating, facts and timeline would be great but you have neither.

I think you're just one of the sue happy people out there in this world. If you were really ripped off why did you wait a year to post your comments on this page. mmmm, maybe because the program was released late last year, and is a success! You just want to bring bad press because of YOUR misfortune. I don't know the facts in this case, but I do know that Steven Burke is a reasonable man. I also know that diplomacy goes a long way.

I said, I am in court right this minute because STeve Burke refused to give me a WORKING COPY of GoldCalling after I paid for it way back in July /05.

We have been using Gold Calling for our business for over 3 months now and have had nothing but success using the program. It would appear to me that Connie simply doesn't know how to use the software and it is a shame to see such a great program receive bad press from those who simply don't know how to use it.

Steven Burke, sold us the Goldcalling software that was never workable. We are taking him to court as I write this.
