Pivitol Payment Texas Breech of Contract Charges before setting up as Merchant Supplier Addison, Texas

Pivitol Payment called and offered me a rate I could not refuse.  I agreed and signed some papers. They charged me an initial $95.  Before they even sent me a terminal for processing credit cards, they began charging me a minimum monthly fee.

I few days later, I received the terminal.  I called Pivitol and told them I wanted to cancel my account. I was very upset that they had begun charging me and had not even set my account up yet.  They said that was fine, but there was a $499 cancellation fee.  I told them that I was told there was no cancellation fee by Keven who was the one that I had dealt with.  They said Kevin didn't have the authority to tell me that.  I told her that nothing I signed said anything about a cancellation fee.  I was faxed a cancellation form to send in.  It also didn't say anything about the fee.

I did not send in the form.  Pivitol was supposed to pay the cancellation fee for my current merchant services company and never did.  Therefore, Pivitol is in breech of their contract to me.

Pivitol called me again last week and asked me about cancelling my services.  I told them I still couldn't see where I owed $499 for cancelling.  This woman told me I owed over $1000.  She told me that page 6 of my contract show how to calculate the cancellation fee.  I don't have a page 6 and no where in my paperwork does it show a cancellation fee.
