Basically I placed an ad. in a magazine and there was a dispute on the amount owed. We came to an agreement and the debt was cleared and has never been on my credit. This was approx. 3-4 years ago. Just last week this company sends me a letter, the first and only one, to say that I owe them $2,084.87. I ask why and told them that this was paid. They said the reported this to the credit agencies on 9/27/07 and that I need to pay them.
I want someone to go after these people. They think they can just ding my credit with no recourse. I am a mortgage broker and know how these "people" work they try to intimidate people into paying old invocies or bills because they know that there is little chance that I will have proof that this was paid.
I will report them etc. through the bureaus etc. but if anyone has any ideas how to make them feel some pain instead of the consumer please let me know.
Thanks,
R J XXXXXXX

Advice for you

Here's your best option at this point:
Find out which credit reporting agency(s) the debt has been reported to. Get a copy of that credit report (you can get all three for free at annualcreditreport.com).
Then, draft a letter to the collection agency(s) stating that you dispute the validity of the debt and that you request an investigation pursuant to the Fair Credit Reporting Act. Explain your position. Attach documents verifying that you have paid the debt if possible. Be sure that your letter references the account number, your name, social security number, the name of the collection agency, the name of the original creditor, and the amount of the debt.
Also write a letter to the collection agency, and be sure to include all those references I mentioned above. In this letter, state that you dispute the validity of the debt and that the debt has been paid. Demand that they perform an investigation into the validity of the debt pursuant to the Fair Debt Collection Practices Act. Attach proof of payment if at all possible. Take the time to wade through those boxes from 2004 and 2005. It will save you time in the end.
Tell the collection agency that, if they do not promptly perform an investigation and remove the blight from your credit report, you will consult with an attorney. Let them know that any and all FDCPA, FCRA, and state law claims, including libel, will be prosecuted to the fullest extent allowed for under the law.
Make sure that all of your letters are sent by certified mail with return receipt requested.
If you have indeed paid the debt, this should take care of it for you. Check your credit report again in 45 days. If the blight is still there, you're going to need to take some more agressive action.

PROOF - NOT SURE IF YOU HAVE A QUESTIONS OR ADVICE

Whether I have proof is not the point. I have not heard a thing about this account in over 2 years. I have immaculate credit and these people come out of the woodwork and tell me that I need to pay something that is over 2 years onld and that they have reported it to my credit bureaus without any notice to me etc. this recent letter that was dated 6 days before they filed.
If I paid this why the laspe before these people come after me - could it be that they know there is not much chance of me having proof without a time consuming search from boxes in storage from 2004-5 taxes etc.
If they want to pay me to prove what I knwo then I am fine with that - but don't ding my credit with notice or reason.
Once again - who can help in this situation???

Do you have proof that you paid anything and proof of the pay off agreement? Without that you owe the money.
