I am disputing a credit charge from Promotora Sunset Beach Clubs SA de CV (Sunset Group) in the amount of $5892.62 Canadian Dollars, which is included on my online banking statement dated January 15th 2009.


On January 13th 2009, my wife and I attended the mandatory timeshare meetings at the Sunset Royal Hotel Located at Boulevard Kukulcan 10.3 Lote 13-B Zona Hotelera, Cancun.


Immediately following the 90-minute meeting, my wife and I were approached by a Promotora Sunset Beach Club sales representative with the intent of selling a timeshare to us. We had repeatedly said no to numerous contract offers by several sales reps and had also stressed that we could not sign a 19 page contractual agreement without our own legal counsel. My wife and I had no intentions of purchasing a timeshare considering our age and limited household income. We had also indicated that our knowledge of the English language was not the best. Regardless of our decision, we continued to be harassed and pressured into buying a timeshare. The sales reps consistently gave us falsified information to persuade us into purchasing a share. They even provided their own hired lawyer to endorse all information that had been told. The lawyer continued to go through the contract with us ensuring that the conditions of the contract were of a standard practice. This had ultimately made us feel intimidated and feel a false sense of security and we eventually gave in to the consistent Duress.


On January 14th 2009, my wife and I had returned to Sunset Royal hotel with the intention of rescinding the contract. When meeting with the sales rep, he had informed us that part of the agreement consisted of keeping the timeshare for at least a year before there would be an option of resale to Promotora Sunset Beach Club. He also informed us that there would be a penalty to pay if we were to rescind the contract. This information that was given violates the membership purchase agreement clause 12.0 Accelerated Termination of the contract. With this said, we feel we have been a victim of unlawful selling practices.
