Sean Keating of Breakwater Yachts went into a contract for shipping one of his clients boats to Australia. There was a mistake made in the measurements and cost, which he was given to ship his boat, which made a significant difference in the price. Our contract states that we can make an adjustment for the full cost of this error, and pass it on to Sean. We decided that we would not take advantage of this after it was determined that we made the mistake. We simply asked Sean to pay the cost not associated with freight and we would pay the difference. Even though it was clear to Sean that we were paying more than he paid us to the ship owner, Sean decided to fight about not paying anything. The contract he signed clearly stated that adjustments could be made, and there can be additional cost other than the freight cost alone. It appears that Sean made promises to his customer without reading the contract and would go to any extent to prove that he is right. Sean states that he does not know where the boat is or what ship it is on. We gave Sean, his partner and the customer the itinerary of the ship along with a customer service contact number. When we were unable to agree on terms, Sean then called the carrier customer service number purposely to create problems with our account. Additionally, Sean posted a complaint on Rip off.com
We have been in business for 3 years. If we conducted business as Sean said, don't you think that we would have more than 1 complaint. For all the customers, shippers, NVOCC and agents, be aware of Sean Keating and Breakwater Yachts. He is not reasonable and will do anything cover up his mistakes.

Allibrasil went out of business within a month of my complaint

The shipping broker, Allibrasil, shut down their website and changed names quickly after this online compaint. We will always stick up for our clients whom have trusted that our recommednation (in this case, unforatately, was Allibrasil) perform exactly as they are contracted to. This shipping broker asked for another $5000 from our client once the boat was in his care on a container ship to Australia. In my opinion, that's a horrible way to conduct business. And Allibrasil was quickly out of business after this mess and my online complaints.

Keith Smith, Allibrasil....so you're filing a complaint about our complaint? Our complaint said that you quoted at boat shipment at $14,500. The measurements were given to you perfectly, you bid the job. You provided the wrong measurement to US Lines, so your cost went up. You therefore asked for $9000+ after the boat was loaded onto the ship...for no clear reason. You settled for $3000 after threatening to hold the boat indefinitely. After the customer paid you an additional $3,000, you stopped contacting me or the customer. we therefore called US Lines and voiced our concern. They stated that you had not paid them a dollar on the shipment and the boat would be held in Brisbane. I had to go through the cradle operator to reach you from there as you stated to him "I'm not speaking with them". The boat was delivered to Brisbane from Los Angeles on 3/28/12 and was supposed to be paid on 3/27/12, it was not. It is now 4/20/12 and the boat has still not been paid for and is racking up storage costs. So if you think that we don't have a valid reason to be livid, I think most will disagree. I will happily pass this post on to the customer after you have paid US Lines what they are due and he can make his own statement regarding his experience with Allibrasil, I am simply speaking of my own, maybe I'm off...but I don't think so. The customer was happy when he purchased his boat from my company and has had a terrible experience since it's been handed off to Allibrasil. There is nothing in it for me or anyone else to manage your shipment, which you did not do, but maintaining happy customers is important, so I've logged over a hundred hours trying to clean up this mess, which is still a mess. A month ago you said it would be no more than 10 days...now you say another week. Pay for the boat Keith and we can put this behind us.
