State Fund was notified in Aug'04 to cancel my Auto Policy. I no longer lived in Massachusetts & I've had coverage with my current provider (Esurance) since Aug'04 in New York State. State Fund, after being notified to cancel my policy, proceeded to continue withdrawing funds from an old checking account.

That account is now negative 100s of dollars b/c State Fund proceeded to deduct about $100/month until earlier this year, when my complaint was finally acknowledged.
I've since spoken with Christina Marshall & was assured that:

1 My address is updated in their system to my NYS address
2 A refund check for almost $900 was supposed to be on the way - this was months ago.

Since that time, I have received no refund check & have been unable to get a response from State Fund on this. Additionally, invoices seem to still be sent to my address in Franklin, MA 02038. Those statements indicate that I somehow owe them hundreds of dollars as of May11'05, which is certainly not possible.

Dear That Guy,

Here is a classic example of a guy who makes people in the customer service industry want to go home and drink themselves silly. For openers the agency isn't responsible for chasing you down to complete forms that would cancel your insurance and if you HAD completed these forms there should be no problem producing them. You don't have this paperwork do you?? NO; because it is either lost or you never filled it out but either way it doesn't exist.

Here's how I know you are full of it and why I know that you probably weren't listening or reading when this was explained to you: The bank account that they were drafting the money from was still open. You know what that tells me? That you have a history of leaving loose ends hanging everywhere and to take it a step further I would be willing to be that you tried to blame your bank for overdrafting you to the point it is at without taking a second to entertain the thought that it may be your fault OR two seperate companies with little or no affilation to one another probably has it out for you (I bet it's that second one). Your bank account was open and your insurance was NOT cancelled. Period. The only thing you did wrong here was that you did NOTHING. If the insurance company tried to take money from a closed account the bank would have kicked it back and your insurance coverage would lapse and eventually cancel BUT you didn't close that account either. So in essence you facilitated this by being irresponsible.

Be a little accountable for what amounts to sloppy bookkeeping and chalk it up a lesson learned and stop being "that guy" who calls up and screams and yells but really doesn't have a cogent argument once you are able to fight through the dog and pony show you put on. Shouting and being unreasonable SOMETIMES makes you right but it will ALWAYS make you a pain in the neck to the people who have to listen to your unfounded claims at top volume. In short, buyer beware.

Not your insurance company's job....

It is not your insurance company's job to educate you on the laws of your state, it is your own. They were merely following the laws that your state has to go by. You should have researched and found out what you had to do to cancel your policy youself. An insurance company is not going to risk being fined because you kept your plates with you (which they have no way of knowing)...that situationis between you and the State which requires plates to be turned in. Take some repsonsibility.

Your first notice to STATE FUND was in March of 2005, and at that time Christina sent you a lengthly detailed email on what the procedure is in Massachusetts to cancel the policy. The policy cannot be cancelled until the plates have been returned. You thanked her in your reply email for getting back to you "so quickly". We keep very detailed records here David.

I have no record of you informing us prior to March 30th 2005. Perhaps you notified the insurance company directly prior to that.

I felt compelled to reply seeing as how your complaint is misdirected, and since I wrote your policy myself back in 2002 and I remember your friend Christina Q. who referred you.

Please understand David, your quarrel is not with State Fund. If it were in our power to do so, we would have cancelled your policy ASAP.

Too Little Too Late

Well, it's good to see that State Fund responded to this over 2 years later.
And it's fine to blame the State of Massachussetts.
But last time I checked, your insurance company is supposed to let you know if there is a problem or if there's action they need you to take.
In this case, that did not happen. I had to find out myself.

State Fund Insurance was not the problem

All insurance companies have to abide by the state rules. Your policy could not be cancelled until your plates were returned as dictated by the Insurance Commisioner of Massachusetts. Once the DMV received your plates, then the policy could be cancelled.

The issue/cause was not State Fund, it is the state of Massachusetts itself.
