Currently when I receive my paychecks they are drawn on an East Coast bank. Since I am unable to walk into the branch to cash my check I must: 1. have a bank account that I can deposit into or cash check or 2. take my check to a check cashing place and pay to receive my money.

Now..I have had quite a few instances like the gentlemen mentions where I deposited my check and (even though its the same check that I have been depositing for 3+ years that I receive Friday afternoon or Saturday afternoon) I was only able to get $100 for that entire weekend.

How can it be fair to allow banks record profits from overdraft fees that are never truly overdraft more like short term loans with insane interest attached -simple timing issues that only benefit the bank. How can it be fair practice for the bank to loan me say $5 in some cases for what ends up costing me hundreds. If I didnt have a disabled husband and disabled 2 year old, I might have more time to take on this fight. So far I get so d**n depressed about it that I dont do anything. It doesnt change the fact that it is WRONG! Its the poor people that live right at the line of what they make that are being punished. This is so freaking wrong.. for you to say there is no case makes ME SICK!! There is a case! Your just to stupid to see it!

Legislation needs to be written that forces employers to offer cash or cash equivalent if payroll isnt drawn on a local bank. Why couldnt employers issue debit cards that max out when the funds are gone? Why cant the bank cut off use of your debit card when the balance is depleted? Perhaps a warning message comes up for what price you will have to pay and you can agree or not to it. There is so much technology that is available to avoid RIPPING OFF THE POOR!!!!

I have never bounced a check to my bank...NEVER and yet they rape me of hundreds and hundreds of dollars and I cant even choose to avoid them.

Oh there is a case I assure you.. even if we need to write new law.. so it will be!

Ok, I think you have a valid point, but at the same time, there are a hundred reasons your payroll check wouldn't clear, despite how long you've been cashing them there. 1. There could be a stop payment on it. 2. The account could be closed. 3. The account could be frozen or have a levy or garishment on it 4. Something may offset the employer's account so that the check wouldn't clear Should I go on? Personally, I wouldn't take the gamble of cashing a check not knowing if any of these factors would cause me to not get money for a check I just cashed.

Overdrafts Are Not Short-Term Loan

A short-term loan is where an institution agrees to give you money (in writing) on the assumption you will pay the money back with a stipulated amount of interest. An overdraft is when you spend money that is not yours, for which you are assessed a penalty. Let's not rationalize an overdraft into anything else other than that.

If your employer allows direct deposit, you would have the entire amount available to you on that Friday. If you have a paper document (specifically a paycheck) that you take to the bank on a Friday after cut-off time for the bank (usually 2PM), you will only have the $100 available to you. All of the other information provided is superfluous, not relevant to the situation, and not persuasive.

The suggestions you provide would lead to massive fraud being perpetrated upon both banks and consumers; if someone takes the card and programs money into the card - who is then responsible for the fraud? The employer? The bank? The criminal? Obviously, it is the criminal, but then who makes the institutions or the employer whole from their loss? The criminal won't have $$ to refund anyone, yet there will be entities out a lot of money when it happens. On top of this, if you lose or misplace a debit card, or it gets stolen from your wallet, then you just lost your entire paycheck. If you lose a paycheck, it can be voided. A debit card for you to spend can't be. I know if you really thought this through - you would know you didn't really give much thought on the ramifications of the suggestions.

You have no case and there is no one who is going to draft legislation when there is a banking lobby who suggests people take responsibility for their spending actions - with all the protections in place right now for the consumer, I would have to believe them. The responsibility of this rests with you; the bank accounts for the money you deposit and then spend. You have the responsibility to competently manage your money, and since it is your money, you are the one MOST responsible for your money. If you aren't responsible for your own money, believe me - no one else will be. Others made suggestions for managing your money better; you can keep more of your money simply by keeping a written register of your transactions and getting rid of your debit card - because that thing is the reason why you're in the situation you're in.

Finally.... everytime you incur an overdraft fee, you bounced a check. That is how you need to think of what has happened to you. I understand it brings you to a boil when you think about it. However, instead of boiling over, take the action you need to stop these overdrafts from happening.

What about asking if your employer offers direct deposit, then there's no deposit hold placed on it.
How fair is it that you spend $5 more than is available in your account and not expect a fee? The other option would be to return the item unpaid, which would still cause a fee at the bank and one at the store.
I'm sorry to hear about your husband and daughter, but they have no relevance to the problem of overdrafting your account. You say you've never bounced a check and yet have been hit with hundreds and hundresd of dollars of fees. If this is true then you are over spending with your debit card.
You can ask your bank to place a code on your account that would only approve purchases up to your available balance. It won't completely stop overdrafts but will reduce them greatly. Of course you might have to put up with the "embarrassment" of your card not being approved.
Another idea is to keep a register of your transactions and not spend more than is available in your account.

IT IS a Federal Banking regulation that banks put a hold on checks and out of state checks for even longer than in state ones. The bank used to be able to give you $300 of the money but the FEDS changed that to $100. so don't blaim the bank, blame the FEDS. BAnks have a lot of regulations they have to follow and if they dont they run afoul of the Feds. Just remember that from now on and know you will only get $100 until the checks clears.
