On June 6, 2008, my 2002 Lincoln, LSE began to make a horrible banging noise underneath the hood. I contacted my mechanic and was advised that I needed a new sway/stabilizer bar, bushings and stabilizer links (these are front suspension components). When my mechanic contacted Warranty America, LLC the claim was denied due to this being a "normal wear and tear issue". They also told my mechanic that I never selected the "additional coverage for wear and tear on my contract." THERE IS NO SUCH CLAUSE on my 2006 contract.
I personally contacted Warranty America on June 10, spoke first with Bo, who told me that what I was explaining was different than the notes taken by the first representative and that I should have my mechanic call again and clarify. The clarification was that on my particular model you cannot just replace the bushings you must replace the entire sway/stabilizer bar because they are sold as one part. The stabilizer links however can be separately replaced and ARE covered but they were not the only part that needed to be replaced. Bo confirmed that the links should be covered at $33.00 each and the labor associated therewith (a half hour) and that my mechanic needs to call to get confirmation. When my mechanic called back, the claim was denied AGAIN due to 'wear and tear' even after my mechanic clearly explained the part(s) could not be replaced separately and that they failed. My mechanic also questioned Warranty America on the replacement of the links. Again not covered this is normal wear and tear. Are they kidding me this is the front suspension. NOT brakes.. It should be noted that in several conversations with several representatives it was told to me that if the stabilizer links break, we will cover them. When I advised my mechanic this he indicated that the links cannot be broken and they probably said that because I wouldnt know that.
That evening I called back and was told an entirely different reason for not being covered something along the lines of the parts can be sold separately and we will cover only those parts I demanded to speak to a supervisor to explain that this was not the case.
I was on hold for 45 minutes-- before Curtis took my call. I was advised again that this is a wear and tear issue. I asked how is a front suspension problem wear and tear? I was told which is so disconcerting-- that if you break down we will cover the part, but since you didnt break down, we cannot cover the part. Maybe you should drive the car until the part fails however you must know that you could lose control of the car, cause additional damage to the front left tires, and possibly more damage AND here is the best--- and if the additional damage is related to this we will probably NOT cover it. ARE you kidding me, drive the car with children knowing the front suspension is not working properly to have the claim authorized, risk lives of others, etc. I couldnt believe my ears. My husbands mouth dropped when he heard me repeat what Curtis just said. When I advised my mechanic about this he indicated that you basically will never break down you will hear a really loud banging noise constantly, your left tire will run the risk of failure, your front alignment will be off, and your steering will be compromised. My mechanic said if I was to run that risk, several other issues will arise. At this point, I figured I cannot argue anymore I will just pay the 600.00 dollars to fix the car.
We all know-Warranty America clients that is-that there would have been another denial due to driving the vehicle which needed repair causing the breakdown. I insisted after 2 hours of back and forth double talk and nonsense that Warranty America at least pay for the Stabilizer links and labor associated therewith, as Bo indicated. Guess what Bos notes were not recorded. Go figure.
I have contacted an attorney and intend to fight this all the way. I paid $2200.00 for a warranty which has since been paid in full. I have had two prior claims for the same thing which were also denied at first, but after 6-8 phone calls finally authorized.
This company will find any which way they can to deny a claim, they are fraudulent in their conversations. I only wish I knew this prior to purchasing this particular warranty, because for the past 2 years I could have invested the 2200.00 and still be ahead of the game. BUYER BEWARE!

Let me reply to many of the things said in these various postings:

1. Stating that my responding to complaints represents feelings of guilt is complete nonsense. I think any reasonable person can see, especially if they READ my replies, that they are simply attempts to set the record straight. I'm not going to allow people to go on the internet and say any baseless lie about my company unchallenged. I would think anyone with a conscience would do the same. That's the problem with the internet - anyone can say ANYTHING, but very little of it is actually true and NONE of it is verified.

2. Anyone can contact the BBB if they like. My point is all that happens then is the BBB forwards that to me. Contacting the BBB is really nothing more than an attempt by most people to publicly hurt us, just like posting on this website. Most people that post online are not truly interested in resolving their issue, or they would have contacted me or us directly! Your name doesn't sound familiar, so if you have a legitimate issue, why is it my compliance people have to seek out your postings on this website? Why did you not contact me directly? It would seem logical that if you don't contact me directly you must KNOW you don't have a legitimate issue and you are attempting to publicly harm us.

3. Check our BBB rating - A PLUS. Enough said.

4. Extended warranties, for the most part, ARE all alike! They cover what they cover and they are not "blank checks" to be filled in by the shop as many people seem to expect for whatever reason. The difference with our company is if we make a mistake we will make it right and not leave people holding the bag.

5. I will defend ANY comment or issue that requires defending, and I ALWAYS will because it's the right thing to do. If we were wrong I will say we were wrong, unlike most companies. However, if we were NOT wrong, I will be sure to say that too!

6. To clarify your last question, what I'm saying is if you, or anyone, attempts to publicly harm us by posting lies, distortions, or misrepresentations without a fair assessment from the other side, then I will not be so willing to help you with whatever issue you may have and we can just let the courts settle it. I don't HAVE to work with people. We have attorneys and we could just let them handle everything. I don't happen to believe that's the best course of action most of the time and I KNOW it's not for the average person. However, if people can't be reasonable, then we don't have to be either.


There was no other information about your situation - contract number, VIN number, or anything else, so I could not find information specific to you. If you want to send it to me I will look at it, but it appears to already be handled. Thanks.

Are you stating here in your response that if something were to go wrong w/my vehicle (or others for that matter) that you will not handle the claim or that you will make it harder due to the venting of this post? Just to clarify... since I still do have a warranty with your company.

People, (first let me state if I hadn't needed to search yet another warranty company, I would have never stumbled onto Paul's responses 6 months late)

Anyone who sits on the computer and responds on 2/9/09 to every compaint obviously has a feeling of guilt. The BBB should be contacted no matter who the company, especially if they are boosting the BBB seal of recognitiion-- because for every complaint the BBB mark's their files. If there are 10 to 15 complaints on one company I am sure the BBB would investigate whether or not to keep them in good standing. This is why Paul says my advice is bad...he doesn't want his company soiled. Plus, the BBB corresponded with me instantly and helped the best way possible.

I fortunately did have some luck w/ this company and I think it was Paul, if not Paul it was some gentleman named Curtis but that was only after insisting to speak w/ the top guy, having an attorney read my contract and compare it to the new contract online, and insisting firmly but nicely.

Unfortunately extended warranties are all alike unless they are from the car dealer themselves. I am having the same issue w/another warranty dealer and if it wasn't for the fact that I am in the legal business, I probably would just give up like most of you.

With no disrespect to Paul, Paul stop defending your company online and answer the calls of these poor people who expect only that that was promised to them. You made your self look terrible by answering every post as if you and your company are on the defensive. Not good to the public eye.

On a final note, for everyone read the fine fine and finest print you see on these warranties. Put that money in the bank for when something goes wrong. I learned the hard way... SOmewhere there is something they will not cover. And always always have an attorney or someone who knows contracts look yours over before you give up on your claim!!!! Paul have a great day!

I am the CFO of the company in question and let me simply say that Nancy's advice is NOT the best thing to do if you would like any claim or issue reviewed. We pride ourselves on being the only company I know where you can actually reach the top executive managers of the company. Most companies the people 3 levels under that won't even take your calls. We are readily available to help any person out if there is a problem. What we will NOT do is respond to threats or public attempts to harm us (such as postings on this site), and if you do that you are seriously hurting any likelihood that we will work with you. We are more than willing to work with anyone that is rational and sensible.

BBB of Colorado helps out

On June 17, 2008, I recieved a follow-up call from Curtis of Warranty America, LLC who indicated to me that unfortunately the adjuster who took the call(s) (there were 4 to 6...) were incorrect and not knowledgeable enough about my contract to deny the claim...

I am to be reimibursed for the full amount spent on stabilizer unit and links.

Payment is to be received by next week. I will keep all updated.

My advice for all who have been denied a legitimate claim that falls within your contract is to contact the DCA of Colorado or the BBB and file a claim. They in fact respond and help.
