XM Labs - AcaiXM Purchased a Acai Berry Dietary supplement program, 10 day FREE trial. Merchandise was not shipped until the 10th day and was billed $139.97 for membership. TOTAL SCAM, and I fell for it. Hollywood Florida

Purchased ACAI XM Dietary supplement program, RISK FREE 10 day TRIAL for $4.95 S/H only.  XM billed my credit card but did not ship the product until the 10th day via US Postal service.  They then billed my credit card $139.97 that same day and shipped the second package UPS Overnight requiring a signature.  I contacted them at 800-440-4397 and they said all sales are final, no refunds because I did not cancel the subscription.  I immediately shipped the package back to them Priority Mail with Delivery Confirmation and filed a dispute with my credit card.  I have yet to receive a refund and my credit card is still mediating the claim.  This is total breech of contract.  If there are others willing to join me in a class action lawsuit, maybe we can shut these people down for good!
