I had a 2017 Mazda lease that was coming to the end of term on Sept10, 2020. The pre-inspection result found that two front tires(cost estimated at $230 each, $460 for two) need to be changed and rear dent (cost estimated at $100) need fixing. We were told that we can replace the tires at a lower charge. And based on our research, we found that the cost the two tires $240 total, include tax and labor fees.  Mazda Capital Services offers their customers $1000 deductible, to be deducted from total Excess Wear and Tear.   On Sept 1,2020 we visited the car dealership, Capistrano Mazda, to explore our options, While at the dealership, we called Mazda Capital Services to ask if the tires were included in the $1000. and we specifically asked if the TIRES are included.

we were informed that the tires are included, and the Capistrano Mazda Sales Rep can attest to that phone call. Based on the provided information, we decided that we will return the car. and we signed a document saying we might be charged for turn in fees, any official fees or taxes, any outstanding payments, and or costs associated with returning the vehicle after the scheduled termination date. Excess wear and tear were not included in that document.  We received a bill from Mazda Capital Services on Sept 22, 2020, stating that out standing fees are $795.65 ( $300 for Disposition fees, $460 for tires, and $35.65 for taxes on all above charges)  Upon contacting Mazda Capital Services, I was told that I am responsible for the full bill, and I was only told that per the original contract, we will be responsible for the tires. I did inform them of the sept 1 phone call, and the manager stated that even if the customer representative gave the wrong information, we are still liable to pay.





When I said that this is not fair, I was told that I could call arbitration, but Mazda Capital Services refused to provide the arbitration contact information, I was only told that I should go back to the original contract that was made more that 33 months ago. I then requested the recorded conversation that was made on Sept 1, at which I was denied and  was informed that the above mentioned recorded conversation will be used for internal training and coaching only.   We had returned the car 10 days before the end of term, with lower than the allowed mileage limit, which could affect the value of the car. The Bill states that the amount should be paid in full now. At this point we feel like we are between two fires. Either pay for something we are not responsible for, or pay extra fees.
