On September 21, 2023,the first instance trial of Ms. Nguyen Phuong Hang and her accomplices for the crime of "Abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and individuals" was held.
  Why does it take one year and a half to bring her to trial? Nguyen Phuong Hang (birth name Nguyen Thi Thanh Tuyen; born January 26, 1971) is a Vietnamese businesswoman, General Director and Vice Chairman of the Board of Directors of Dai Nam Joint Stock Company. In 2021, she became widely known through her livestreams on social networks denouncing a number of artists, celebrities, and journalists. Having settled in Canada at the age of 16, Ms. Hang later married an overseas Chinese husband and had a child with him. At the age of 23, her husband passed away and left her and her children an inheritance worth $18 million.

Denouncing Vo Hoang Yen's fraud On March 1, 2021, Nguyen Phuong Hang together with her husband, Mr. Dung, spoke out to accuse Vo Hoang Yen of fraudulently appropriating more than 200 billion VND from them through people's relief activities. Because of this statement, on April 16, Ms. Hang was fined 7.5 million VND by the Department of Information and Communications of h*o Chi Minh City for providing false information and insulting the honor of the People's Committee:  Binh Thuan province.
 This livestream on Ms. Hang's personal Facebook page at one time recorded more than 225,000 viewers at the same time. The two livestreams on the YouTube channel "Dai Nam Racetrack" and Dai Nam Company's Facebook page also reached more than 163,000 and 80,000 viewers at the same time, respectively, which is said to have set a streaming record The most viewed online video at the same time on Facebook in Vietnam with nearly 500,000 concurrent viewers.  Hoai Linh later defended that he had intended to give it to the people before the Lunar New Year Tan Suu, but because of the COVID-19 outbreak he had to postpone it.  However, this explanation by Hoai Linh later encountered mixed reactions from public opinion and fans on the grounds that there were times when the epidemic was completely controlled. On February 16, 2022, the Police Investigation Agency of h*o Chi Minh City Police issued a decision to temporarily suspend the exit of Ms. Nguyen Phuong Hang. On March 24 of the same year, h*o Chi Minh City Police prosecuted and detained her for 3 months on charges of abusing democratic freedoms to infringe on the interests of the State, legitimate rights and interests. of organizations and individuals according to Article 331 of the 2015 Penal Code.[58][59][60] Police and the People's Procuracy of h*o Chi Minh City came to search Ms. Hang's house in District 3 a few hours later.  She was taken to temporary detention at T30 Detention Camp, Cu Chi District, h*o Chi Minh City.[63][64] On April 17, h*o Chi Minh City Police confirmed that Ms. Nguyen Phuong Hang also has the citizenship of the Republic of Cyprus.  On April 22, Binh Duong Provincial Police also prosecuted Ms. Nguyen Phuong Hang for the same crime.[65][66][67] Through investigation, Binh Duong province police collected 53 of her live streams showing signs of crime. ] On June 18, Binh Duong Provincial Police transferred the case file to merge with the file that h*o Chi Minh City Police was investigating. However, h*o Chi Minh City Police have not been able to receive the application yet.[73] On June 22, the h*o Chi Minh City People's Procuracy decided to extend Ms. Nguyen Phuong Hang's temporary detention for another 2 months.
On August 18, the h*o Chi Minh City Police Investigation Agency issued an investigation conclusion and recommended the prosecution of Ms. Nguyen Phuong Hang. According to the investigation conclusion, Ms. Nguyen Phuong Hang organized many live broadcasts with unverified information, using humiliating words, insulting the honor and dignity of many people. On August 19, the People's Procuracy of h*o Chi Minh City continued to extend her detention for another 20 days.

On September 6, Binh Duong Provincial Police transferred the entire case file to the People's Procuracy of Binh Duong Province to request the prosecution of Ms. Nguyen Phuong Hang.  On the same day, the People's Procuracy of h*o Chi Minh City returned the case file to h*o Chi Minh City police for additional investigation.[84][85][86] Accordingly, Ms. Nguyen Phuong Hang was asked to extend her detention for another 1 month and 27 days.

On November 1, Binh Duong Provincial Police transferred the case file to merge with the case file in h*o Chi Minh City.[88][89] On November 3, the h*o Chi Minh City Police Investigation Agency continued to issue investigation conclusions and recommended the prosecution of Ms. Nguyen Phuong Hang.  According to the investigation conclusion, Ms. Nguyen Phuong Hang used many accounts on YouTube, Facebook and TikTok to livestream to offend many people, the most videos had nearly 1 million views.

Previously, on October 14, Nguyen Phuong Hang and his family submitted a petition to the h*o Chi Minh City Police and h*o Chi Minh City People's Procuracy requesting to be released on bail;[93] on October 24, his son She also asked to deposit 10 billion to guarantee her release on bail.[94] However, on November 10, the h*o Chi Minh City People's Procuracy did not accept the application but continued to request the temporary detention of Ms. Nguyen Phuong Hang.[95] On November 29, 2022, the h*o Chi Minh City Police Department continued to order Ms. Nguyen Phuong Hang to be detained for another 2 months for additional investigation at the request of the h*o Chi Minh City People's Procuracy.[96] Through additional investigation, h*o Chi Minh City Police prosecuted three individuals, assistants and secretaries, for helping her commit crimes.


On September 21, the first instance trial of Ms. Nguyen Phuong Hang and her accomplices for the crime of "Abusing democratic freedoms to infringe upon the interests of the State, the legitimate rights and interests of organizations and individuals" was held.  At the trial, Ms. Hang honestly testified. Initially, she refused requests for public apologies from singers Dam Vinh Hung and Thuy Tien because she believed that "the past 18 months were too high a price to pay" and she was "in too much pain". However, by the end of the trial, she cried and "apologized to everyone she had touched whether accidentally or intentionally." Ultimately, the first instance jury sentenced Ms. Hang to 3 years in prison and Mr. Dang Anh Quan to 2 years and 6 months in prison. The three assistants, Nguyen Thi Mai Nhi, Le Thi Thu Ha and Huynh Cong Tan, each received 1 year and 6 months in prison. In addition, all five defendants were also forced to jointly pay compensation to Ms. Dinh Thi Lan and journalist Dang Thi Han Ni of VND 18 million each. Because singers Dam Vinh Hung, Vy Oanh and husband and wife Cong Vinh - Thuy Tien dropped their compensation claim, the jury did not consider it.  In addition to sentencing Ms. Nguyen Phuong Hang and her accomplices, the jury recommended that the Police Investigation Agency continue to investigate and handle Mr. Dung "lime kiln" due to receiving many petitions, including those from Ms. Hang's son. , although previously in the conclusion of the additional investigation it was stated that there was not enough basis to criminally prosecute Mr. Dung.
