QC Electronics Equipment not delivered as promised - refused to refund for un-deilvered equipment. Wilder Kentucky

I purchased a large amount of equipment from Craig Curk totaling over $40,000 including shpping expenses. One of the pieces of equipment was a Heller oven for $6,000 with an edge/pin rail configuration. I was told this oven was being cleaned and run and that I would recieve several approval pictures.

I never did and still have not received any pictures of the oven. The oven is approx 13' long and weights about 3,000 lbs. I have to rent a forklift and operator to take it off the truck at my expense. When I received the equipment delivery I immediately noticed the heller oven I was shipped did not have a pin rail. This is not the oven that I paid for. I removed the other equipment from the truck and placed the Heller oven back on the delivery truck. I did not accept delivery of the wrong oven.

The oven was rusty, had badly bent panels, some of the leveling feet were missing, the under frame was badly bent from being roughly picked with a forklift, one of he exhaust ports leading to the manifold was clogged solid with ash and these are just the issues that I cold tell from viewing the oven inside it's plastic wrap.

After seeing what poor quality the oven was in that I was sent I was sure that I did not want any oven from Craig. Either Craig was trying to pass this oven off as the one he promised me and hope that I would just accept it, or somehow they care so little that they accidentally shipped the wrong 3000lb 13' piece of equipment half way accross th country?

Sure mistakes happen but it seems that even a simple verification of the asset tags before something is loaded on a truck would be done at a minimum. I informed him that I would just cancel the order for only the $6,000 and not worry about the shipping that I paid for an oven I did not receive. Craig refuses to refund me.

$6,000 is such a small dollar amount and such a small percentage of the overall purchase price. If he had refunded that money I would certainly have done future business with him. I would certanily not do business, nor recomend that anybody else does business with him. I guess it's possible that the dollar amount is to much and they simply don't have the funds.
