I contracted with 411 Tax Relief around October 17, 2008 to have them help resolve my 2005 and 2006 Taxes with the IRS, which was billing me for over $100,000 per year.

I heard nothing from 411 for two months and called them in December of 2008 and was turned over to an Alvin English who after much hesitation said he needed additional information which I sent him immediately and followed with a call to make sure he had received it.

Again I heard nothing for two more months and called Mr. English again who told me he had not worked on it yet but that he would do something immediately and get back to me. Having still heard nothing by the end of February I called again and Mr. English just shined me on, that he was busy with current tax clients to meet the April 15 deadline.

At that point the IRS was adding more penalties and interest so I was up to over $150,000 owed in back taxes. I tried calling other tax advisers to find out what I needed to do. After some extensive research I found what I thought was the problem with my returns and filed amended returns for both years with the resulting settlements of $360.00 and $340.00 for each of the subject years.

At that point I called 411 to ask for return of my fee. I have talked to a Paul Cheeseman 310-401-6934, whom I think is just a salesman. He gave me the name of Crystal Rooney who supposedly is 411's CFO and makes decisions regarding money matters. I have called her and E-mailed her to no avail. Someone down the ladder called me at one point to tell me they would not return my money. I asked why and she knew nothing. Ms Rooney just will not respond to calls or E-mails. Company Rebuttal re Robert [Ripoff Report #383780]

Our firm prides itself on doing a good job for ALL of our clients. We have a good reputation and work hard to maintain our good name.

Sequence of Events in this case:

1) Client hired us 10/15/2007 for IRS Representation and Tax Investigation regarding IRS tax problems with 2005 and 2006.

2) on 10/24/2007, we determined from IRS records that the client did not report his day trading activity on his 2005 return, and the IRS responded by assuming that his stock sales were 100% income to him, resulting in a tax bill of $146,000. A similar problem was developing with his 2006 tax return.

3) On 10/27/2007, we e-mailed the client a tax organizer asking him for his basis in the stock sales for 2005 and 2006, so that we could prepare accurate returns for him.

4) On 10/29/2007 we confirmed in a telephone call that he had received the tax organizer.

5) On 11/6/2007 we received 2005 and 2006 broker's summary statements from the client, without the required details listing stock purchases and sales.

6) On 1/24/2008 we again requested stock basis information from the client to match with the stock sale information already reported to IRS.

7) On 8/26/2008, client returned another call from us and told us he had solved the problem with the IRS himself, and that he wanted a refund. The reason for the refund request is that he did the work himself.

Summary of issues in this case:

Early on during the term of our Service Agreement, we determined the source of the problem, and described to the client what information we needed to fix the problem. In response, client followed up with IRS, and fixed the problem himself. He then requested his money back because he did the work himself. His refund request was properly refused because we had a valid contract in place, which included a provision that the client cooperate with us, and timely provide us with requested information. He did not do this. A binding contract cannot be changed merely because one party chooses to unilaterally void and bypass the agreement. Our work was done properly and timely, and our firm should not be penalized because the client changed his mind and did the work himself after learning from us what the problem was.
