Aames Capital Corp., / Aames Home Loan and EMC Mortgage Corp., purposely set me up while I was in Chapter 13 Bankruptcy. There intent was to force me out of BK 13, and steal my home, by saying they would refinanced me and I was APPROVED. The loan officer from Aames called to remind me to NOT too make my next payment to the courts, they would be closing the in 3 weeks, and there is no reason to make the next because it would throw there figures off. Do to me filing Chp 13 Pro Se; I had to hire an attorney to come out of the Chapter 13.

In May 1997, I refinanced my home with Standard Financial Corp. Immediately, the loan was assigned / transferred to Aames Capital Corp., / Aames Home Loan. I was given a 3-year Pre-Payment Penalty. All the while with Aames, I contacted them numerous times trying to get them to refinance my loan to a lower interest rate. According to them, it couldn't be done due to the pre-payment penalty. I could have refinanced with a different lender, however, the pre-payment was still there and that would be eating up the equity in the property. Also, the other lenders quoted a rate of 9% or higher. The lenders claimed I was a non-conforming borrower; the loan fee's they were quoting were unbelievable!

The term of the loan with Aames are $107,500.00 30 Yr ARM 12.50% Rate 3 Yr PPP.

Finally, to no avail, I could no longer make the payments in a timely fashion and was about to be foreclosed on. So, August 2002 I had to file Chp 13 - Bankruptcy (Pro-se). All the while in the Chp 13 Plan, I was able to remain in my home with the courts protection, and my mortgage payments were maintained in a timely fashion.

While I was in Chp 13, June 2003 - Aames Capital Corp., / Aames Home Loan contacted me (they solicited me) and claimed they had a SPECIAL NEW PROGRAM for borrowers like myself and in this situation.

I live in Seattle; Aames hired an Appraiser and ordered a Pre-lim Title Report. They pulled a credit report and took down my financial info. I went through the normal loan-qualifying steps. They called again informing me of my APPROVAL; and this was a SPECIAL LOAN PROGRAM for borrowers in Chp 13 - BK with them.

The loan officer and processor both, called to remind me to NOT too make my next payment to the courts, they would be closing in 3 weeks, and there is no reason to make the next because it would throw there figures off.

Do to me filing Chp 13 Pro Se; I had to hire an attorney to come out of the 13. For almost two months, they had me on hold thinking the loan was approved and the signing of doc's was near. They would call and say the documents were in the mail and/or special carrier sent them. They would call and give me all these excuses for the doc's not arriving. Whenever I would call the loan originator, loan processor and his supervisor, they were unavailable. They would transfer me around to different loan officers and processors. I no they were still working there, but they were purposely avoiding my calls. When I did finally find out my loan was NO longer APPROVED, but DENIED, it was through another loan officer calling from Aames soliciting me all over again to do a refinance.

At this point I ask to speak to his manager, which just so happen to be the 1st original loan officers supervisor. He said the loan had been Denied because a Pre-lim Title Report showed it was a Notice of Default (which Aames put there). Aames placed it on the Title and they could have removed it to let the refinance through. They refused to take it off, even though they put it there and they solicited me!!!

October-November 2003, they turned the loan over to EMC Mortgage Corp., for servicing. They would call consistently through out the week with their rude selves. EMC were set to foreclosure May 2004, which, again I was forced to file another Chp 13. I was able to stay in the Chp 13 until January 2005. It has since been dismissed and I am now schedule for Foreclosure Sale, April 1, 2005.

My point here is, Aames Capital Corp., / Aames Home Loan and EMC Mortgage Corp., purposely set me up while I was in Chapter 13 Bankruptcy. The only reason Aames Capital Corp., / Aames Home Loan - sent an Appraiser to make sure the property was properly maintain. They were preparing to transfer the loan to EMC Mortgage Corp. According to Aames, the value was $349,000 - the balance owing, including principal and arrears was at $150,000. There was more than enough equity in the property. This was Aames Home Loan and EMC Mortgage Corp., way of FORCING ME OUT of the Chp 13 - Bankruptcy so they could transfer the loan servicing to EMC Mortgage Corp., whom are now trying to stealing the property.

I am aware that time is of the essence, and I must either refi or sale my home. However, I am trying to keep up and see which is the right path for me. I no there are others whom have gone through the same thing. Please do all you can and stay away from both Aames Capital Corp., / Aames Home Loan and EMC Mortgage Corp.

PLEASE BE BEWARE of there Scam and Corruption, Foreclosures, Fraud, Intimidation, Mortgage Sharks, Steal Equity, SETUP by both Aames and EMC Predatory Lenders... They will rob you and break up your family...
