Comments about using ABI's "Terms of Service"

AUTHOR: Starr - ()

POSTED: Saturday, October 12, 2002

First of all I would like to thank you for putting up this website so we can be aware of the hoaxes on the internet. I had put an order in with ABI and then decided to do some investgating on my own. When I read all the complains on your site, I wrote to them telling them to credit my card. Hopefully they will do so... I will wait for the statement to come...

Anyways I read there rebuttal on this page stating to read the "Terms of Service" on there site.. well if there was one existing it could be possible instead the link just goes to
C:\newmc\mc1-5-02\main tml\MC\terms_of_service.html

There isnt any. SO I guess this goes to show exactly what kind of company "if its a real company" this is...

EDitor's Comment on the above REBUTTAL

Dear Sir or Madam,

If you are an attorney, Canada is in trouble. Your opening statement betrays how ignorant you are. We are not attorneys, but it is fairly common knowledge that slander concerns the spoken word and since this is not an audio file, it can not be slander, not even in Canada.

Since this Internet-based website is considered written your case would be libel. Learn to know the difference. We appreciate your contribution, however, because it only reinforces what incredible jerks some proprietors are and the basic need for our website.

Before we came along, this person would have to try to deal with you privately, and that's to your advantage. Now, you are under a microscope. How you deal with this customer is revealed to potential future customers. The only reason you could possibly object to this situation is if you have something to hide. You have made an idiot of yourself because you mishandle your customers.

Why don't you save your attorney's fees you would have wasted on suing us for "slander," and rethink the morality of your position. It just isn't worth it to try to get rich on the backs of people who want to trust you.

Washington state appeals court ruled Communications Decency Act (CDA) immunizes Amazon.com from liability for possibly defamatory comments posted on its web site by customers

16. CDA HELD TO PROTECT AMAZON.COM

A Washington state appeals court ruled on September 17th that the Communications Decency Act (CDA) immunizes Amazon.com from liability for possibly defamatory comments posted on its web site by customers attacking an author. Author Jerome Schneider attempted to hold Amazon.com responsible for the posts, alleging defamation and tortious interference with a business expectancy. One of the posts suggested that Schneider, whose books often discuss tax avoidance methods, is a felon. After Amazon.com raised the CDA defense, the complaint was revised to drop the

defamation claim and allege negligent misrepresentation and breach of contract, arguing that Amazon.com had decision making authority over the content. The CDA says that an "interactive computer service provider" can escape being judged as the "publisher or speaker of any information provided by another information content provider." Schneider's lawyers argued that Amazon.com isn't an ISP like America Online, whose service

actually connects people to the Internet. The appellate judges said that they saw little difference between AOL's role as a bulletin board host and Amazon.com's provision of a free-for-all book review service.
