READ THIS: At 9:40 on June 2nd, I received a call at work from a man from ACADEMY COLLECTION SERVICES stating that I was in collections for a debt with Sam's Club. He loudly told me that Sam's Club charged off the debt and now I was in collections. He told me that he had my SS number but when I asked three times, he refused to verify it. He refused to tell me his name. I told him that I have NEVER received any notice that Sam's Club was trying to collect anything. When he told me the address he was sending the notices, I told him that the address wasn't mine. He said it DIDN'T matter if I received the notices or not, I owned the money. I guess ACADEMY COLLECTION SERVICES never heard of the Fair Debt Collection Act!

I have a Sam's Club account for my business, but I don't charge anything on the Sam's Club card, so this rude call confused me when he said I owed money to Sam's Club. I guess if the collectors talk fast, are rude and abusive they will intimidate me. Wrong. I'm a decorated Marine, a Vietnam Vet, and I'm offended that he would talk to me in an abusive rude way. If he was an adult doing his job, then show some respect and talk to me like a man. If you look at the Academy Collection Services website, it declares that they are professional and curteious. That statement from their website is an abject lie. Period.

Facts, according to Acadeny Collections:

All mail for demand for monies was send to 707 La ____ Roswell, NM.
Account was opened June 2006
Sam's Charged -off $2,556 Feb 24th 2008
It was a personal debt.
He had my Social Security Number (they refused to verify it)
This was all that he would tell me, except to be VERY abusive and LOUD and at one point, he shouted at me.

Facts According to me:

I don't live at 707 La____ Roswell, NM. I never have, I don't own the property, and don't know who lives there.
The account was a business account opened by Linda W____for a restaurant.
I was on the business account to buy food for a restaurant.
My Ex-wife owned the restaurant.
My Ex-wife closed the restaurant for good on or about closed June 2007
I've been divorced for over a YEAR!
I NEVER received any mail or letters from ACS!

I told the rude man from ACADEMY COLLECTION SERVICES that it doesn't matter where he sent the mail, I didn't receive it, and they have to follow the law, and besides, it was a business account, a business that I did NOT own, nor held any stock in. All he would do was yell at me telling me that he was going to enter into the record that I was uncooperative and refused to pay the debt. HE would NOT listen to anything I said.

I cautioned him several times to speak to me in a civil tone. When he shouted at me again I hung up. He called right BACK, and started YELLING telling me that I was not cooperating and I would sorry. I hung up again and immediatly got on line and found this great website.

I encourage anyone who has had a negative experience when dealing with ACADEMY COLLECTION SERVICES to lodge a complaint here, and then go to the Federal Trade Commision website at www.FTC.gov and file a complaint.

I'm guessing you mean the federal Fair Debt Collection Practices Act. You can download it fromt www.ftc.gov

IF you were listed as a PARTNER to the restaurant business, you are liable for any and all debts of the business-that's what partnerships are, all partners share in the profits and can be held liable for the liabilities-the creditor does NOT have to go after each partner to collect or sue. The creditor can PICK ANY or ALL partners to collect and/or sue for the partnership debts.

Your marital status and/or divorce is irrelevant.

If the restaurant was a corporation and you were an OFFICER of the corporation, you might be held liable for any and all debts of the corporation IAW the laws of the State in which the business was incorporated and how it was structured.

I think you should consult with a competent attorney about this. What I'm telling you is that it boils down to what your position with the restaurant was. If you were listed as an employee, which means you were paid wages, had a w-2, income taxes and such, I'm pretty sure you can't be held liable for the restaurant's debts. IF on the other hand, this was a joint-venture, or other type of partnership, you very likely have a problem now.

Dig out any and all paperwork you have about this restaurant (including your income tax filings) and consult with a compentent attorney!!
