ACTION HEAVY HAUL, LLC FRAUDULENT ACTIVITY, LIE, DON'T PAY THEIR INVOICES Medford Oregon

My insurance was involve and have deal with this claim long time ago. Action heavy have nothing to do with the claim because there are not own the building and have no contact with the owner for that building.

We have contract signed by from Action heavy haul sign and agree to pay us for that move and we did it and receiver have signed the BOL that prouv we delivered that load without problem.

Action heavy haul cannot provide any infos or invoice about that claim. They make a choise do not pay and ignore our phone call.

 My driver that day touched the fence and provide our insurance formation. My insurance take care of that long time ago and case between my insurance and shipper is close. Action Heavy Hauld have nothing to do with that claim. They don’t own the building. By the law freight have nothing to do with the claim. Action heavy haul have to pay their invoice. Kevin can you provide the invoice for the repair? No because you don’t have and you have nothing to do with that. I called you several times and send the emails but you ignored. You don’t want to pay your invoice that’s it. All carrier be careful. Don’t deal with this broker.

Hermann Trucking was contracted to haul two shipments from Lebanon, NJ to Toronto, ON. They signed, and agreed in writing to provide us with two trailers to haul the materials.
Not only did they show up extremely late, but they also failed to provide two trucks...they only provided one.

Since the customer was under contract to have the material moved, they had no choice but to load all of the material onto one truck...in the dark...due to Hermann Trucking's failure to arrive on time.

Upon tying down the shipment, Hermann Trucking then crashed into a building at the loading site, causing massive damage. They provided insurance information but refused to file a claim.

Prior to delivery, Hermann Trucking then held our customer's freight hostage and demanded to be paid for two shipments even though they only provided one truck. Under duress, we sent over a revised agreement indicating that the charges were "accessorial charges". Line 6 of the Action Heavy Haul Broker-Carrier agreement ( that Hermann Trucking signed ) specifically states that "accessorial charges, including layover and detention to be paid in a timely manner upon receipt of accessorial charges from the shipper." Since the customer is not willing to compensate us for the accessorial charges without being reimbursed for their building or providing two BOL's for the two trucks they ordered, we are not willing to cave to Hermann Trucking's insignificant and baseless demands.

We have all of the emails, documentation, and pictures to defend and justify our counterclaim.
