Oceanside Gym Owner Pleads Guilty to Using Gym Members’ Credit Card Numbers to Steal Thousands in Merchandise

Thomas Donovan, 39, of Island Park, used personal financial information belonging to clients of kickboxing gyms he owned.

MINEOLA, N.Y. – Acting Nassau County District Attorney Madeline Singas announced that an Island Park man pleaded guilty to using his clients’ personal financial information to steal thousands in merchandise from Home Depot, and for possessing a loaded firearm found in his home.

Thomas Donovan, 39, pleaded guilty today to Attempted Criminal Possession of a Weapon in the 2nd Degree (a D violent felony) and Grand Larceny in the 3rd Degree (a D felony) before Acting Nassau Supreme Court Justice Jerald Carter.

Justice Carter gave the defendant a sentencing commitment of three years in prison followed by three years of post-release supervision. Donovan agreed to make restitution of $17,719.27 to Home Depot and $690.50 to an Oceanside scrap metal recycler. He is due back in court on April 8.

“Using personal financial information to steal comes with serious consequences,” Acting DA Singas said. “Thanks to our partnership with the Nassau County Police Department’s Crimes Against Property Squad, we are actively combating this growing sector of crime in order to protect consumers, as well as the legitimate businesses they patronize.”

Acting DA Singas said that between Nov. 17 and Dec. 9, 2014, Donovan, as the owner of 5 Star Kickboxing in Oceanside, previously known as KOXO Kickboxing, engaged in a scheme to fraudulently obtain property from Home Depot by using credit card information of individuals who signed up for fitness classes at his gym.

On multiple dates, Donovan acted in concert with another individual, who would visit various Home Depot locations in Nassau and Suffolk Counties to select various items for purchase, bring them to the Pro Desk, and supply the cashier with the name and phone number of a fictitious contractor.

Home Depot employees would then call the telephone number to obtain credit card information for payment. Donovan would answer the phone, assume the identity of that fictitious contractor and supply, as payment, credit card account numbers, security codes and expiration dates without the permission or authority of the cardholder.

The credit card information used to pay for the Home Depot merchandise was obtained by Donovan from clients of his kickboxing gym.

As part of the scheme, Donovan scrapped stolen wire for $690.50 with an Oceanside scrap metal recycler. The wire was later seized from the recycler by police as stolen property.

During the investigation, eight search warrants were issued and executed at the defendant’s home, business, and vehicles. The defendant was found to be in possession of a loaded .25 caliber pistol as well as thousands of dollars of Home Depot merchandise.

Donovan was arrested by the Nassau County Police Department Crimes Against Property Squad on Dec. 9 at his Island Park home.

Members of 5 Star Kickboxing, or Donovan’s previous business, KOXO Kickboxing, who suspect unauthorized charges to their credit card accounts should contact Acting DA Singas’ Tipline for Crimes in Nassau County at (516) 571-7755.

Tom Donovan of Donovan Media, Explosive Media Inc, The Web Leaders, NY Law Professionals

AUTHOR: Former Employee - ()

POSTED: Friday, March 21, 2014

Tom Donovan of Donovan Media also known as Explosive Media Inc, The Web Leaders, NY Professionals, Donovan Media Studios, and other scam business names is one of the slimiest dirty scammer you will come across. He will greet you with open arms and smiles and once he earns your trust he will disappear and your business will be in limbo online with no way of getting in touch with him for months. All people should check their credit card statements and if they are still doing business with Tom Donovan of Donovan Media also known as Explosive Media Inc, The Web Leaders, NY Professionals, Donovan Media Studios, and other scam business names then I suggest running as fast as you can.

We also are a group of former employees from a few years ago and we got scammed and he still owes us money from work we performed for him and we are still seeking justice after all these years now. He claims to have big time lawyers on his side but he has sooooo many lawsuits for fraud against him right now that anyone stupid enough to go with him for a site deserves to have their money taken. Do research on the web before making a decision! All you have to do is Google Explosive Media Inc Reviews, Donovan Media Reviews, The Web Leaders Reviews and you will see the sad stories you find about the clients he has taken advantage of. This guy needs to be put in jail for a long time so he cannot hurt smaller businesses anymore.
