I HATE this company!!! I have been dealing with them for the past 14 months in regards to my adjustable rate mortgage. My interest rate has continued to adjust every six months. They have refused to work with me as far as lowering and fixing my rate, therefore not providing me with Loan Modification.
I'am currently behind on my payments and I will not work them further. I will HAPPILY take part in a class-action lawsuit on this company. Somebody please do something. President Obama, please put them all in jail!!!

You sound surprised that the rate of an adjustable rate loan is being adjusted. This is the loan you took out.
As for Biden, he has been in the US Senate. Incorporation laws for a state are set by the states, not the feds.
I don't mean to sound indifferent to your situation, but you have not shown anything illegal or unethical here.

First you got an ADJUSTABLE rate mortgage. As far as I am aware there is no requirement that a bank must "modify" the loan. But there is also nothing that says you could not have attempted to Refinance the loan with another company to a FIXED rate. When you got it you knew the rate was going to adjust..hence the name ADJUSTABLE Rate Mortgage. What are the grounds for this Class Action Lawsuit?
Also, I find it interesting how everyone thinks that President Obama is going to waive some magic wand to help their particular situation. You have to remember that VP Biden was a Senator from Delaware. Delaware has one of the least restrictive laws for Corporations and Banks in particular. This is why a majority of Banks are based in Delaware. So do you really think anything is going to change????
