My husband had download a 3-month free trial last year and then call to cancel the membership in August 06. There was no problem in dealing with cancelation as it has been reported by so many people, so we think AOL has been ethical and get their act together.

Just a few days ago, my husband checked his bank statement and found that there has been charges from the cancelation date, August 06 until June 07 (10 months).

He put a stop payment with a bank and called AOL to get refund on this fradulent charge. The response: the customer rep tried to lie and said the account was active. So my husband told it was cancelled by phone in August and said he know the conversation was recorded. So, she checked the record and confirmed that it was cancelled in August 06. She told my husband to send copy of the bank statements to show that the charges were made. It does not make sense to me why they cant see this in their payment record, instead having us to prove the charges. Also, she gave a wrong fax number to which the letter/proofs were to be sent.

I have read so many similar cases out there...can someone/EDITOR please tell us whats the outcome of their request for refund? what should we do if they gave hard time to get the refund? any information on class action suit in MA?

Hi Melinda & Husband,

Like I have read your letter that you have wrote and Im glad that you are taken some steps. this is what I did with that company. I just got so sick and tired of all there bull crap. I was tired of talking to all the wrong people and getting know where. So after the last phone call with aol they made me mad and pushed all the wrong buttons that was enough. No man will tell me to shut my big fat mouth up my own husband. dont talk to me like that. after that supervisor Paul said that to and that I'm not getting my money back will I just him on the phone now you can speak to the judge and at that point I went down to are court house here and filed for small claims.

I did not want it to come down that way I was being nice and they could of been nice back. After all they did steal moeny out of my checking account that did not belong to them. Well after filling out the paper work for small claims and paying for the court cost the court sent them a letter that I'm taking them to court I filled the small claims court 7-16-07. now this is august 6,2007 and they send me a letter saying that they are going to send me a paper check in approximately 15 business day. well today is august 13, 2007 and I got the check in the mail but Im still taking this to court because I WON WON WON boy that is a good feeling to say you won.

It should of never came to this and we should never had this kind of headache calling those people on the phone and dealing with them. if your husband has called 2 times and has not gotten anywhere with them then I would just take them to small claims court .what do you have to lose. they took from you it is not like you took from them they owe it to you. email me here and let me know what you find out I know the stress you are going threw we should not have to go threw this but again I would like to hear you say you WON WON WON WON it is a good feeling. Hi Shellie,

Thank you so much for the information and replies to my post. I feel better at least knowing that we're not alone fighting a company like this. My husband has called the Fraud Dept twice. We got this paper to file with them. HOwever, the paper sounds like someone else has been using the account and we're charged for that. However it isnt the case as you know. AOL charged us and they make it sounds like the account has never been cancelled and someone else was using it. We're still waiting to see how they are going to response to that paper.

They are very tricky. The first time my husband call to a customer rep. She then send us a letter as if we have just cancelled the account on that call in June, whereas we called to let them know we want refund as we've been charged illegally after cancellation in AUgust last year.

We do have intention to file to a small claim court. is that what you're doing? I wish you well.. Let me know the outcome.

I understand what you and your husband have been going threw I have done some research on the computer and found some information for you I hope this will help you out. One this is the address of aol 22000 Aol Way Dulles, Virginia, 20166 this is for if you need to take them to court. If you dont want to do that just yet you can call the fraud department at aol at 1-800-307-7969 and see where you get with them there if you call any other number to aol you will get no where you will get the run around.

I have called so many people about this matter at aol alone I spoke to 11 different people and the last one did me in. Now Im taking them to court and lets hear what the judge has to say now, lets see if the judge will get the run around like other millions of people get.

Don't feel like your the only person out there that aol has done this to it is sad. I to have canceled with aol but they thought they still can continue to go into my bank account and take money out of it. One month it would be $28.90 the next would be $30.90 sometimes they would take out to times in one month. I just really think they are hurting for customers really bad and they need money. Well they are not getting no more of my money you had said that they gave you the wrong fax number that does not surprise me that sounds like aol. They would not give me phone number all they said is you have to send your bank statements to aol billing operations services I said gee that would be great but how about a address well we cant do that and they hung up on me so I called back

I did get the address so if this will help you out good luck because I'm still waiting aol billing operations services P.O. Box 65627 Sterling Va, 20165-8805. I also found on the internet a phone number in califorina for America Online Inc. (415)844-9000 I hope this will help you out. It stinks that a company has to be like this best wishes to you and your husband in trying to get your money back I still waiting they did give $61.80 back out of $897.20 that they owe me. Good Luck
