NO ONE EVER DEMANDED YOU RETURN MONEY, I SIMPLY STATED THAT IF YOU WOULD LIKE TO RIGHT A WRONG THAT YOU SHOULD RETURN A "PORTION" OF THE MONEY YOU TOOK FROM HER! I STAND BY WHAT I SAY, YOU NEVER FILED A SINGLE MOTION AND NEVER ENTERED YOUR APPEARANCE ON THE CASE! YOUR "LEGAL RESEARCH" THAT YOU SUPPOSEDLY PERFORMED IS QUESTIONABLE AT BEST! I HAVE NOR WOULD I EVER THREATEN YOU OR YOUR FAMILY AND I HAVE NEVER "DEMANDED" ANY MONEY FROM YOU SO STOP TRYING TO MAKE YOURSELF OUT TO BE THE VICTIM!! I am responding because I believe the public is entitled to the truth rather than statements that defame a person and are merely made in anger.

I was hired by this complainant's sister after she already lost her custody battle in court.  I did not "take" thousands of dollars from this man's sister.  This is a false representation.  I was hired by this man's sister to do a specified amount of legal work on an uphill case.  I never promised to make several immediate motions or appeals for this woman.  This is also misrepresented.  As with any litigation, as information develops strategies do and must change.  They did in this case and the client was notified of this.  In fact, the brother who makes this defamatory report also knew about the changes as the case progressed.  Motions were not filed because they could not legally be filed without breaching the state code of ethics.  The clients demands (after the fact I might add) would have required me to violate the code of ethics and possibly subject me to discipline by the state disciplinary board including possible disbarment.   

It is a complete fabrication that I did "NOTHING FOR HER".  I performed over 25 hours of legal work when I had been only paid for 20 hours.  I did not enter my appearance because I was prohibited from filing the motions that client wanted because I could find no legal and ethical basis to do so as is required by our state rules of Professional Conduct.

This is not an accurate report.  What it is, is the brother of an angry client who spend their money hoping that I would be able to stop a Judge's Decision that went against this woman after trial.  Some people expect miracles and when you don't deliver them they demand their money back or blame the last attorney involved.

These people knew what was going on every step of the way and I was very clear with them that it could be costly and that I might not be able to to anything for them at all.  It is very clear from the internet postings they are making to now force me into giving back the money I earned that they don't like the result and blame me for it.  If they wanted a guaranteed result . . . or better yet a miracle then perhaps they should have hired the Pope.

This has shown me that you just can't please everyone and as much as you may explain things to clients and keep them informed on their case, they only care about results that I can't guarantee and they selectively remember only what supports how they feel in the end.

This is not truly a report.  This statement about me is blatant defamation designed to injure me and my practice because they want to force me to give back money that I rightfully worked for.  I wonder how many people would be happy if your boss approached you at the end of the week and said they didn't like your work and wanted you to give your paychecks for the past few months back.

I will continue to treat all my clients with excellent services and respect as I have done for more than two decades.  However, I had to respond and set the record straight in this forum.  If my response is allowed to stand without further rebuttal, then that is fine.  We have each had our say.  If the reporter continues further, regrettably I will be forced to take action to prevent further defamation by these false statements both against the posting party and against Ripoffreport.com for allowing clearly defamatory statements to stand.

For those who are not aware of it, there is a big difference between expressing your opinion (which IS protected by the US Constitution) and maliciously defaming a person's character by making statements that imply knowledge of provable facts recognized by the law.

This is a misrepresentation.  As with any litigation, as information in any case develops strategies do and must change.  What we hope or intend to do in the best case scenario is not a promise to file things that require a legal basis that are within ethical guidelines.

These people knew what was going on every step of the way.  I was clear that it could be costly and that I might not be able to do anything for them at all.  I am now being defamed all over the internet as a robber and a thief and this poster has demanded that I return thousands of dollars to the client even though I did the work.  

I am sorry they don't like the result and that they blame me for not being able to do what they wanted done.  If they required a guaranteed result . . . or better yet a miracle.  I would not have accepted a dime from this client.

For those who are not aware of it, there is a big difference between expressing your opinion (which IS protected by the US Constitution) and maliciously defaming a person's character by making statements that imply knowledge of provable facts.  I hope that people are conscientious when making postings and are certain that they are posting a true "opinion" and not something that is libelous and purely intended to hurt someone else.  The "Original Report" and its title are defamatory and subject to legal action.  I am hopeful that despite the damage this poster has caused to me that he and his family move forward and discontinue these actions.

I am an advocate for the underdog, the underprivileged and those who cannot defend themselves.  I want to continue to do this good work for people.  I certainly do not wish to take legal action beyond this posting to protect my livelihood and my business.
