As shown, Cody brags on himself on what a great businessman he is.  Of course not listed, as the CEO of Avatara Services LLC., having TOTAL MANAGEMENT AND OPERATIONAL CONTROL, BANKRUPTED THE COMPANY, SCAMMING MILLIONS OF DOLLARS FROM VENDORS!!

On March 27, 2014, Avatara Services, LLC. dba Avatara, LLC. filed Chapter 11 Bankruptcy in the United States Bankruptcy Court for the Western District of North Carolina, Asheville Division, Case# 14-10150, Tax I.D.# 61-1519804.  In the bankruptcy documents received, Avatara LLC. was awarded multiple federal contracts from the Veterans Administration (VA) – National Cemetery Administration (NCA) of $4M in 2012 and $7M in 2013.  There are over 60 creditors, multiple federal and state taxing authorities, and many subcontractors all over the United States, which have been “RIPPED-OFF.”  Where did all the money go? 

As listed on the bankruptcy documents, Samuel C. Cody and Larry E. Jackson show only modest personal income taken from the company.  However, the Asheville North Carolina U.S. Attorney’s Office conducted a “Rule 2004” financial document examination and deposed Samuel C. Cody and other current and former employees, and based on the documents and testimony, Samuel C. Cody put Hundreds of Thousands of Dollars into his pockets, meanwhile RIPPING OFF ALL THE CREDITORS!  Even after filing bankruptcy, Cody and Jackson were able to keep control of all the government money coming into the business for over 7 months, and funneled tens of thousands into his pocket and the pockets of family members and wives, until the U.S. Attorney’s Office removed him from his CEO position and a outside bankruptcy administrator appointed. 

This most despicable part of the actions of Samuel C. Cody and Larry E. Jackson, is Jackson, as a recognized service disabled veteran, given his status, and 51% majority owner, Avatara was able to bid on Federal Contracts under the Service-Disabled Veteran Owned Small Business Concerns (SDVOSB) program as set forth in the Veterans Entrepreneurship and Small Business Act of 1999.  This was an enormous competitive advantage to Avatara.  Almost all of their contracts were grounds maintenance and headstone realignment in our Veterans National Cemeteries, a place of honor for our Veterans.  Cody, utilizing Jacksons service disabled status, in a classic “RENT-A-VET SCAM”  prayed on all its vendor’s and passed himself off as a honorable businessman.  We vendors, thinking we were assisting a honorable veteran in their business pursuit, got “SCAMMED.”  Cody and Jackson robbed other legitimate SDVOSB’s which should have received these contracts.

The VA-NCA government contracting officers also played a part in this “SCAM.”  They were notified of Cody and Jackson’s conduct, not paying their vendors, TWO YEARS before they filed bankruptcy, and AVATARA HAD SEVEN (7) LAWSUITS filed against them all over the country.  But did nothing!!!

Avatara Services LLC., is still in business!!  As most all “SCAMMERS” do, Samuel C. Cody has formed other businesses to RIP-OFF more people.
