After ongoing water leaks in my apartment, possible mold infestation, management negligence of investigating possible mold complaints even after my two trips to emergency hospital with doctor stating possible mold contamination as a diagnosis and numerous complaints of air quality when turning on AC and heating unit.  After the last water leak in my unit and my constant complaints of possible mold infestation and management refusal to investigate such claim, I was forced to move.  I could not use AC in summer due to compromised air quality every time I turned on the unit so management brought me fans....instead verifying if my claim for such was legitimate.  My low utility bill proves, I could not use my unit.  Finally, winter approached and now I had to turn on my heat and again, the compromised air quality made me extremely sick.  I again notified management and finally, was forced to move.  Management agreed not to charge me for see below email from the regional manager.  Yet, after they inspected my unit and verifying I had vacated the premises, they pursued an eviction despite the written agreement to not charge me.  The sad thing is I had no idea until I began having my credit ran.  To  my surprise I verified, they infect did not honor their written agreement of not charging me for the ongoing problem.  After numerous attempts of trying to reach them by phone, email, and certified  mail, they have continued to avoid my calls and correspondence.  I have all my supporting documents and communication between management and myself.  To this date, no response, which has forced me to file a complaint with the BBB, FTC, Attorney Generals Office, Consumer Complaint Company and now Rip-Off report.  My objective if for them to honor their written agreement and to reimburse me for the two pieces of furniture I had to leave in the apartment due to possible mold infestation.  I have had to call to file a police report on February 13, 2011 for them removing the two items left without coming to an agreement for reimbursement as promised by Belinda Clark the regional manager.

I have had two hospital trips due to this "sick building", have had to carry an epi-pen, had an anaphylactic attic, and had to injected with steroids and benedryl due to me being contaminated by mold.  I have had to sleep in my car while paying rent due to me becoming sick in the apartment and all of this was brought to the attention of management with supporting documents.  I even purchased a do it yourself mold kit from Home Depot and took it to the office to show them the various mold spores in the dishes.  Yet, they just ignored it.  Finally, when I decided to have my own inspections, management asked me not to but to allow them to do an inspection and they would get back with me.  I had already vacated the building and only had the furniture I could not take with me, a couch, chair and mattress due to infestation.  After they inspected the unit and saw that I had left, to my surprise, they stopped responding.  See below.

I have contacted corporate and Mr. Woodard only to again be ignored.

Please help!  Again, all I have ever wanted was to be made whole, nothing more or less.  I pray they honor their written agreement.

Thank you,
Victim of Mold and now Breach Agreement

To: Good Morning Ms XXXXXX:I am back in the office today from being out on PTO. I have not had the opportunity to talk with Misha this morning to get all the details regarding your complaints. As mentioned in your email, you have begun packing and are moving out. I will make sure to put a note in your file explaining that no cancellation/notice fees are to be charged to you.

Subject: 3rd requestHi Belinda,
Thank you for acknowledging my previous email regarding my mold issues in my apartment. As we discussed, I will be out of that apartment soon. However, although you contacted me acknowledging my complaint and advised me you were out on PTO, the issue regarding replacing my furniture has not been addressed. Because I have not heard from you regarding replacing my furniture, leaves me no choice but to have my apartment inspected by a licensed mold inspector. This test will cost me $600. I will also contact the EPA and other health regulatory agencies to have them come inspect my apartment, as each time I go over there just to gather some of my belongings, I get sick, literally.
I am not sure you are aware that it rained in my apartment again in the same area you had them replace twice since the work you had done. Your maintenance crew came in and saw where the water damage was and only drilled holes in the wall but never came to dry it out or replace the wet Sheetrock or carpet which caused re infestation. So, when you turn on the heat or air I think the mold spores multiple quickly. It affects the air quality and my breathing. It causes me to be extremely lethargic and head achy. I have asked your staff several times if the air ducts were cleaned out because of this problem each time I turn on the unit. Yet, they think I am just a complainer instead of investigating my claim.
In any event, I am not sure you all truly understand the hazards of mold and the damages it causes but it is serious. It can not be cleaned out of cloth material and thus, furniture must be properly disposed.
Once my complaints are validated which I am 100% confident they will, I will contact an attorney who specializes in mold and pursue a law suit.
I have tried to work with you all and just wanted to be made whole but you all seem to refuse to acknowledge my request. Again, when you look at my furniture you will see it is in excellent condition and I would have no reason to replace it except for the mold contamination. I will have a mold inspection this week and I will forward the bill to you all as well as the results,.
Once all testing is completed, I will be completely out of that apartment. I will leave the items I can not take there in the apartment for disposal.
Again, to avoid a lengthy costly lawsuit, you all can agree to replace my furniture and once I'm gone, this will be over. However, if you refuse to acknowledge or cooperate it leaves me no choice but do what I must to make me whole.
A reply would be appreciated.
This is my third request.

Hello XXXXXX:

Before you authorize any inspections, please allow me to assess the damage and speak with you regarding the issue in your apartment. This will allow us to determine our obligation as the landlord and your obligation as the tenant. Libby Jansen (Regional Vice President) and myself will be available to meet with you on Wednesday, January 19th anytime between the hours of 8:00 am to 5:00 pm. Please let me know what time works best for you. In the event that you are not able to meet with us on Wednesday, we can still inspect your apartment and discuss with you over the telephone.
