Barry sold us real estate in Raleigh, North Carolina and got them to over appraise it working with the builder PCS Homes.
I bought one home for 150K, Barry received a 25K commission. I flew up there once Barry stopped returning my calls and found out that PCS Homes was selling the same unit for 129K.
They found an appraiser that would provide questionable reports, as no homes in the appraisal were like the one i purchased.

Loan Fraud/Barry Powell aka Barry Power - HBI

Yes, Barry Powell is now with HBI Group on 2401 Fountainview in Houston, Texas. They did the same to me with an appraisal. His company ordered an appraisal and they requested I put more money down since appraisal came in low. Then, I noticed it was missing a bathroom and a storage room. Unbelievable!

I didn't find the appraiser, and I never ever even talked to the appraiser.
I gave Joab almost my entre commission! He put -0- down. He evidently wanted to get cash at the close and equity as well. Ths was an out of state deal; Barry never even saw the property Joab was buying. Barry did nothing wrong. My phone number s 281-303-3182. I never stopped returning Joabs calls. That is flat false. He fails to mention he had a positive cash flow on rental income as well!

Mr. **** forgot to mention in his complaint that I gave up over $20,000 of my fee and that thousands of net dollars went into his pocket, and I wound up with less than a 3% fee on the deal! Seems like this detail was overlooked.
I never met the appraiser nor did I ever speak to him or have any commmunication with him whatsoever - and not even to this date! I never spoke to any representative of PCS hHomes concerning the appraisal. Joabs assumptions and assertions about me are totally baseless. And as far as not returning calls...that's really a whopper. I return all calls and considered Joab a friend and always returned his calls particularly fast. The entire transaction was done sight unseen; neither Joab nor I ever saw the property prior to closing.
When Joab complained, I suggested he call the appraiser direct, but he refused.
When I pointed out that he had a tenant with positive cash flow he said that was not relevant. I guess he wanted to pocket thousands of dollars and have a good equity as well with nothing out of pocket and positive cash flow.
When Joab said he was contacting the FBI for loan fraud, I explained that he was the principal in the transaction and that if there was any loan fraud that he was the guilty party. Why he assumes I had anything to do with the appraisal is beyond me. I am a Texas real estate broker for 29 years and provided Joab with full disclosure of everything I knew about the investment. I withheld do data from him.

LOAN FRAUD

You and your lender are victims of loan fraud (over inflating the values of property). You need to contact the local FBI office here in Houston. Since this appears to involve a lot of money (many victims) and involves interstate commerce, the FBI has jurisdiction. Good Luck.
