To be honest, i am completely shocked that you did not even make an effort to contact me to discuss this, prior to your posting with this forum.

I would like to respond to your posting with the complete truth.

The company that you placed for collection was and still is... Out of Business. This account in question was placed on 11-06-2015 and was finally collected on 12-14-2015. 

(That's more than a few days like you reported)

As per the client agreement we remiteed payment to you the first Friday of the following 15th of the month following the collection. (The post of BB&A paying you in 2 months is also NOT CORRECT)

               I.      All funds received by Assignee in payment of the Assigned Accounts shall be forwarded to the Assignor (less Assignee’s commission) by the first Friday following the 15^th of the month following collection.

We ended up getting the arranger of the freight (a company that did not hire you)... which has already paid the Out of Business Debtor Company for this load once, to pay again.

As far rates are concerned… our rates are on a sliding scale. Depending on the total amount the debtor owes and the age of the debt at the time of placement, our rates are charged accordantly.

If you would like... i can post the client agreement on this site, that you signed. Which clearly states - "If the Account is out of business, bankrupt, second placements (placed with a collection agency prior to placement with Baxter, Bailey & Associates) or a lawsuit is filed; the rate is Fifty Percent (50%) on collections made.

This provision is directly under where you signed "your name".

99.9 % of the time our (4000 clients nationwide) are happy that we were able to facilitate recovery on monies they are owed, on an out of business account.

I am truly sorry, that you did not understand the provision on an out of business account "in Bold Print" on the client agreement. We have this clause placed “right under where you sign your name” so there are not any misunderstandings as too what we charge to collect on an out of business account.
