We have had our mortgage with beneficial/household finance for almost 10 years. We filed Chapter 13 bankruptcy in 2002. Our mortgage was included in the bankruptcy, so our mortgage payments came directly from the trustee. Our payment was never late for the 6 years that we were in Chapter 13. Before we filed Chapter 13, we were only 355.00 behind and that was caught up early in the Chapter 13, so every thing was up to date.

Our interest rate on our mortgage is ridiculously high at 10.9%. When we came out of Chapter 13 we wanted to refinance our mortgage with another company to get a lower interest rate

As we were trying to get a payoff balance, Beneficial threw all kinds of deferred interest and fees at us in the amount of 16,000 dollars. We talked to our Chapter 13 attorney about this, and it ended up in court. No one from Beneficial ever showed up in court. We went to court 3 times, and finally the judge ordered our account to be credited in the amount of 16,000 dollars.

Well, I guess I don't have to tell you, Beneficial didn't comply with the court order. They credited our account in the amount of 9,000, but where is the other 7,000 dollars??? Nobody seems to know. On top of that, the next month statement showed 6,000 dollars of interest added to our account!!

It looks like we will be going back to court, which means that our Chapter 13 has to be opened up again. To date, we also have not been able to refinance, so we are still stuck paying the 10.9% interest.

This is just on the one loan that we have with Beneficial. We are also unfortunate enough to have a second loan with them. But, we won't even get into that one right now. Hopefully, when we go back to court, everything will get straightened out, but I'm not going to hold my breath.
