Biker US Kept DHL insurance and did not refund the $100 to me Englewood Colorado

I purchased two Snow Scooters for $640 plus $100 shipping. They arrived crushed and inoperable. It was a christmas gift for my two children to give while at our winter cabin. I thought that it would take their mind off the devastating divorce that I am going through. I was wrong. They did not work at all.

After finally making one work by removing all the broken parts and basically connecting the gas line to the engine I made it work and it did nothing at all. It never could run in the snow so it was a lie from the begining. I asked for my money back and the owner told me that he had to get it from DHL and then I could get the refund. I explained that it was my gift to my kids and I did not have anything more to give them or any money left. No matter, had to wait. We waited and finally DHL refunded the the entire amount to me for the messed up scooters and picked both up from my cabin. So Biker US got the sale and I collected the insurance money. Well DHL refused to send me the money from the shipping of $100 and said they would have to send it to them but that it was not $100 as they most likely made money on the shipping. I did not care but it did not matter. The owner refused again to pay me now for the shipping.

After numerous emails to him and threats that I would do this he still said that he could not give me back the shipping fee until he was paid by DHL which I know he was paid because I have the letter from him and DHL that they spoke. So as a final resolution before I take him to small claims court months later I am filing this claim and then a claim to the courts. I am owed the $100 for the shipping not to mention the pain and suffering and time spent.
