3 videos were returned to Blockbuster- -they claim they have no record, chrged me $35 which I refuse to pay, now they have me in a Collection Agency.

Just Returned

I have been to our local bb and asked for a movie that was out, they often look at the ones just dropped in the outdoor drop off and rent it to me without checking it in first

Yeah, that doesn't matter.
If someone goes to check out a movie, it has to be checked in first. A movie may not be checked out to more than one account at a time. A little screen will pop up asking to check the movie in to check it out. You hit Y and it's checked in and then checked out to the current customer.

There's also a report called an FOS. FOS is Found On Shelf. It gets done every morning and looks for movies that are 7-8 days late. Of course, some are found. It doesn't mean employees aren't doing their jobs, it could be also a number of OTHER things...for instance...someone new was just hired and every new person misses a few. A customer came up and asked something and eyes looked away and someone grabbed the movies. Blockbuster employees are humans, they (we) are not 100% perfect. And before you get mad over a movie...just remember, it's a movie.

Isn't it against the law for a credit repair company to charge fees BEFORE doing the work? The website asks for fees upfront before any action is taken by your company.

Seems to me this is what got Hargrave & Associates in trouble with the FTC

I work for a credit repair company who deals with collection agencies every day. By law a collection agency is a third party and can only attempt to collect a debt. However, they annoy the hell out of you. ( phone calls, letters, threats, and putting the item on your credit report in negative standing.) What I do is actually remove these items from the credit report. If they are not removed the item can stay on your credit report for 7 years. Check out my website.

I rent 10-15 movies per month from Blockbuster, and it is not uncommon for me to get a recorded phone call about a movie I never returned. It always turns out that a blockbuster employee forgot to "check-in" the movie when it was returned. Apparently, they are just too busy to do their jobs. My suggestion would be as follows: visit the store and request to speak with the manager. Have the manager physically scan every copy of the particular DVD title in questions. Odds are, it will show up (especially if it is a slow moving title). Another possibility is that Blockbuster already found their error (because someone wanted to check out the movie that you supposedly have and the computer system caught it) and then Blockbuster never notified the collection agency.
