Blue Dolphin Pools of Brevard is an installer of fiberglass insert pools. The pool manufacturer is Blue Hawaiian Pools of Largo, FL.

We signed a contract for a pool, deck and screen room on June 15, 2006. We paid the first installment of $5800 for startup. We paid $17,400 for installation of the fiberglass insert. Per our contract, we were supposed to pay $4350 before the deck was installed. We paid the $4350 for the deck and when I returned home the deck was not done. I attempted to cancel the check and it was already cashed.

I called the city to find out if they have performed the inspection for the installtion of the deck. They advised me that the permit was not even issued yet. The city soon after posted a Stop Work Order on my front door. This is where the fun began.

I repeatedly attempted to contact Clark Brown, owner of Blue Dolphin Pools, to find out why they began construction without a permit and when he would finish the job. My calls were VERY rarely, if ever, returned.

The city advised me that they would not issue a permit until Blue Dolphin, or their screen room subcontractor, applied for a screen room permit. Clark ignored the city building department until they threatened to not issue him any further pool permits in the city of Palm Bay. He finally got the subcontractor to apply for a screen room permit.

On top of that, he waited more than 30 days to file for the permits required to do the job and collected more than 10% of the contract price. This is a violation of Florida Statute 489.126(2)(a). He has a similar complaint filed against him with the Florida Department of Business and Professioanl Regulation and can be researched online.

I have repeatedly attempted to contact Clark to find out when he will attempt to complete the job. He continues to ignore my calls. To his credit, he has poured the deck on or about September 1, 2006.

I have sent Clark a certified letter, on or about September 1, 2006, advising him that he is taking an unreasonable amount of time to complete the job and that if he does not complete the job in a timeframe that we can both agree on, I would assume that he has abandoned the job and that I would seek legal advice. He soon contacted me and told me he would be out the following week to finish the screen room and install the tiles. He has yet to show up and has not returned my calls. He has not contacted me for 5 weeks now.

As a result, I have filed a complaint with the Florida Department of Business and Professional Regulation (DBPR).

Clark has repeatedly lied to us. Prior to signing the contract, I told him that we wanted the pool complete by August 20, 2006, for my son's birthday. He told us that the pool would be ready in 2 weeks. When the 2 weeks passed I began to panic. He assured me that the pool would be ready by August 20. He told me that he would complete the screen room the 2nd week of September and never showed up or called. He has taken money from myself and my family. In my opinion, he is a very dispicable person and I don't know how he lives with himself. I HIGHLY recommend that others do not do business with him.

I tried contacting the pool manufacturer, Blue Hawaiian Pools, to see if they would be able to help. They have done nothing. I asked them if they would do the right thing and refuse to sell him pools until he finishes our job. They continue to do business with him.

Believe me Clark - you have not heard the last from us.

Some work was finished, but...

Blue Dolphin has finished the deck and has refunded us money to finish the pool enclosure; however, there is still some electrical work, gutters and final inspection remaining.

I have had to spend an unbelievable amount of time trying to contact Blue Dolphin Pools in order to try and get this matter resolved. Per our contract, it is still not fully resolved.

This could have all been resolved a long time ago if Blue Dolphin Pools didn't avoid me and would have refunded my money sooner.
